Hello Sir, We have recently booked a flat through assignment agreement from 1st buyer. Now 1st buyer is forcing us to register the property within 15 days because 1st buyer wants to settle some bills from builder through that(1st buyer is contractor of the builder). Is it correct to register the property when only civil work has been done in the flat and tiling and painting and other finishing work is still pending. Please advise.

A. Looking at your agreement terms would be better for us to solve it

How to prove if a person is mentally ill so as to admit him in mental health institute and also to restrain him from signing documents that are prejudicial to his interest as well as interest of family, especially when he is not willing to(As per Indian law)?

Financial loss was caused to a government department due to professional misconduct/dereliction of duty of an employee. The employee has since expired while the trial (employer had filed case for damages) was going on. There is no trail of any money which shows that the employee had got financial benefit. Can in such a situation legal heir's can be sued.

A. In all probabilities, it can not.

I HAVE RECEIVED MY BOOKS FROM PUNE WHICH WAS SENT BY RAILWAY TO DELHI .I HAVE SUFFERED A LOSS ,AS IN MY BOOKS ARE WET AND EVEN SOME BOOKS ARE IN WORST CONDITION BECAUSE OF THEIR CARELESSNESS ABOUT MY PROPERTY.I NEED COMPENSATION PLZ LET ME KNOW THE PROCEDURE.

I'm based in pune and recently became member of 'Maintenance Co-op society' but due to illegal demands from society for monthly membership of Rs.2000/- i gave resignation from its membership in writing to society and co-op sub-registrar court. But society refused my resignation that once become member one cannot resign and has to remain compulsorily member of the society. So there was hearing on sub-registrars office on April 5,2018 but still i did not receive any order from the court. Sub-registrar had told me that membership of Maintenance Society is optional it cannot be forced upon. 1) why the court is not giving verdict and sub-registrar is telling me not to worry you will get order copy soon? 2)can i file a case against society for cheating as they took signature on CHS form instead of Maintenance Society form and in bye-laws that copy is still attached with sign on Hosing Society form?

A. File a writ petition before Bombay High Court for direction on sub-registrar for early disposal of the case.

I've become member of Maintenance co-op Society which was formed since last June 2017. The application form on which I had signed mentioned mentioned heading of co-op housing society. But when society was formed it came under maintenance co-op society? I had given resignation letter from society membership which society refused to cancel my membership. So, i approached sub-registrars co-op society court they told me that 'Maintenance Society Membership is Optional". Society cannot force me to stay as it's member. They should accept resignation. So, there was hearing between society and me in co-op court. Hearing is complete on 5th April 2018 still the court has not given any order copy. The sub-registrar is telling that will give on saturday so now 5-months completed no order till now and i'm tired of following co-op office. The reason for my resignation was that society was asking me monthly 2000/- and others 200/- and was against my Paying Guests and insisted me to keep family!!!! 1) Can i file cheating case against maintenace society because they took signatures on CHS form and society was formed as Maintenance Co-op society? So that society license is cancelled. 2) why is co-op court not giving verdict since hearing has been completed since last 5-months? 3) Will society convert it's 'Maintenance Society' into 'Housing Society' by giving monetary or political influence to sub-registrar?

A. You have not stated which state you are in. Take the help of a lawyer dealing with societies matter, you have an appeal to Assistant Registrar or Deputy Registrar, cannot go to High Court directly.

I applied for the post of assistant professor according to the eligibility criteria given in notification. There m.phil holders prior to 2009 were eligible. But now the recruitment board is not taking them. I have qualified it's written exam with good marks and secured my name in the merit list. Plz give a legal advice.

A. You can challenge it only if they take lesser qualified persons instead of you. But if they do not recruit that post at all, you have no case.

I am adopted and owner of property.adoption in 1964 .now a will has come of 1945 by my father property to his cousins.my father died in 1970 and after that property in my name today. Kindly give us advice is will in existence or not.

A. If there's a Will it needs to be probated. Obviously you can challenge on various grounds but before that I need to review the documents relating your adoption and the content of the will. Legal positions cannot be answered without complete facts, as the answer will differ from one facts to other facts.
