It is advisable for you to file a case of cheating under 415 of IPC and 107 IPC for the misrepresentation and concealment of material facts.

Sir , What is the meaning of " case disposed " - "contested and dismissed" . In such a situation any probability to get a favourable order / judgement to the petitioner by the concerned Judge ?

A. Case disposed means case has been decided either by Judgment or other way. Contested means this case was contested by the concerned party on merits and dismissed means dismissed for some reason without any positive outcome. Serving them with legal notice of your intention is the smart thing to do in this situation. You do not need the society's NOC as you are non-members. They will not be able to object to the sale as long as it is done in accordance with provisions of the law.
