I purchased cold drink bottle on 22/4/2020 from shop keeper and when opened it ,the carbon dioxide gas was not fizzing out .I was in doubt and checked manufacturing date and expiration date.To my shock it expired 3 months before and when I went to return the bottle ,shopkeeper refused to take it back as it was open.

A. Dear Sir,
Immediately lodge complaint with all the concerned and send the bottle for chemical examination through police or department. You will be compensated if approach the manufacturer and threaten him to take the matter in social net work. Become rich while serving the society. My husband and I paid for a Europe tour package with Thomas Cook India which has now been cancelled because of Covid 19.We are working physicians in the USA, we have to arrange for flights and visa ourselves and so we were assured that we would be given a full refund if the tour did not happen on the specified date we requested by email,after which we confirmed our booking.However,Thomas cook is now refusing to refund our money and offering only a credit note minus cancellation charges despite our requests to multiple custoer care agents and managers explaining our cancelled vacation and the above.Will filing a complaint against them get us a refund or will it be futile?

A. If the assurance by Thomas Cook to refund the entire value paid, in the event of tour not happening was in writing in any form ( in the contract paper, e-mail, letter etc.), then you have a good case. And moreover, COVID-19 is a unique force majeure situation all over the world, which must have its force on all contracts. You must also check the force majeure clause in their contract paper for the tour.

The issue won't look as a big deal here in Arunachal Pradesh now at presently due to covid lock down we as consumers are exploited again.I went to buy a sugar since I needed half kg they told me they only have 1kg or 300 gm so I was asked to go for one I planned to take for 300 GM for which they are charging me 30 rs which is extra since they are giving us 60rs a kilo for sugar. And I couldn't purchase I kg one since I only have 50 rs. I asked them why they are charging so high for which they responded by asking me to leave. I know this look a silly question when we are indeed at a worst situation with covid 19 case but this issue of harassment is more or less disrupting our daily live too.

There are government circulars regarding overpricing amid covid.
You can file a complaint at the local police station and you can also share your experience on social media by tagging all the concerned departments and authorities.

Hi, I purchased their all season offer package on 5th August 2018 under the name of my wife, Rekha Kumari and paid Rs. 97000/- instantly using my credit card (12 EMIs). This package was to be valid for 10 years and allowed stay of 70 nights in India and abroad. All the properties to stay be of 4 or 5 star as this package was for luxurious stay. I tried for booking 2 times in last 1.5 years. In 2018, they first denied booking by saying that I have requested for booking too early. Then I tried for the second time and they said the property was not available on the requested dates. I tried second booking in Oct 2019, this time again they asked the same thing that I have requested too early and need to wait for the opening window. When I checked on other online portals then it was clearly showing that all the rooms of said property were full on that date. I asked them to give me the RCI card as promised by them at the time of buying the package then they denied of such commitment. When I asked about the booking charges then they asked me to pay exchange rate + AMC for booking. Dispute :- At the time of signing the agreement, their manager Mr. Imran promised below things to us - 1. RCI card will be given to me after 90 days of registration ((Also mentioned in the starter kit mail sent by them) so that I could book hotels as per my need and there would be no dependency on Starinn Suites and Retreat for booking. 2. All starinn properties are of 4 star and 5 star - This is wrong 3. I'll need to pay exchange rate for RCI hotels and Annual Maintenance Charge for Starinn properties. But in agreement, it was written that Annual Maintenance Charge would be applicable for all types of properties. When I objected on that Mr. Imran assured me that he would arrange a mail and later on, he denied. Same ways, I objected on many points which were not looking customer friendly but he assured that mail would replace all those clauses and there would be no problem in service so those clauses would never be invoked. 4. This is all season offer and there will be no blackouts Proofs:- 1. I have a mail chain where their representative has confirmed that "AMC is for starinn property and Exchange rate for RCI" 2. It's clearly mentioned in their starter kit that RCI card will be sent to the customer but they denied to send it. Even MR. Imran confirmed me on Whatapp that they were to send RCI card when i asked him, after 90 days of registration. Same issue is with many customers, who have reported similar type of issues on different portals. I have been battling with Airtel Customer care for the past 6 months (Since november 2019) about improper network coverage. There is no proper response or resolution. There is no network coverage in my locality and airtel has been giving me vague reasons for not fixing it. Also since I am a postpaid user, they are expecting me to pay for a service that is non existent. I have not been able to use their network since raising the issue. I have all the corresponding mailtrails and voice recordings. They even have closed the DOT Complaint raised on the PGPortal.

A. Dear sir
You can serve a legal notice upon them.
Or you can also request for porting of the sim and once you get a call from Airtel you can negotiate, as suggested by another learned advocate.

Are airlines liable to pay full refund in bank account if filght is cancelled by airline because of COVID 19 as per Indian law?

Please refer to the circular issued by the government in this regard.

I have taken an insurance policy, its a family policy after 3months my wifes name is removed from the policy showing non disclosing of pre existing disease, they removed with out any notice, now i opted for cancellation of policy, now they are not cancelling my policy, Can i file a case against the company

They cannot do any unilateral action you can approach Banging Ombudsman or Consumer forum.

Sir. I had taken a 1 year membership of local gym in my society. I had taken due to 3 reasons- it was in my colony, personalized training, 24hrs open(as i have time only in night). Gym facilities were not good. We were not given diet chart, insurance policy as promised by owner even after 6months. Main problem was that gym was closed after 6months without any notice. I was trying to reach out to him and finally when i got through him he told me that gym is being shifted to new location. New location is not near my colony. And it will take more time to commute to new place. Around 30mins(total up and down) extra daily in night for going to his new gym location. I have asked him for refund for 6months. He has been avoiding me but finally one day said that he will allow my balance 6 month membership transfer to any new member who joins his gym and that new person can pay me. He asked me to submit a written request as well for this. But seems like this was just to delay things so that I get tired and stop asking him. New members have already joined his gym but he never contacts me for this membership plan. Is there any ground that I can take a legal action against gym owner ?

Hello sir, I had ordered some food from Swiggy the previous day and my 9 year old son has suffered severe food poisoning after eating Paneer. Swiggy had offered me a refund after I chatted with one of the agent but I refused to take it as I'm spending more on his medical expenses than the order amount. He has been unable to retain water due to vomiting and stomach infection. Doctor has advised hospitalization if the issue persists. Kindly help me regarding this issue so that I can file a case and claim damages in this regard. Thanks and regards

Nestaway is a start up which helps people find rented apartments in their area. They manage everything from rent agreement to deposits to receiving monthly rent from tenants. They have a fixed cycle of rent which means you have to pay rent within first 5 days of each month to avoid penalties. I moved in to one such flat on 27th of August, 2019 and left the apartment on 19th February, 2020. I paid rent for 7 months - 5 days of March, entire month's rent of September to January and 19 days of February. Now, according to their policy (https://faq.nestaway.com/docs/cancellation-and-refund-policy), they pay back half the deposit amount if tenant has stayed for less than 6 months and full deposit if tenant stays for more than 6 months. I have received only half the deposit amount and I was wondering if I have any legal standing to ask for the full amount. I stayed in a flat in Mumbai, Maharashtra and I think Maharashtra Rent Control Act (https://housing.maharashtra.gov.in/Sitemap/housing/pdf/actsrules/THE_MAHARASHTRA_RENT_CONTROL_ACT.pdf) should apply for all legal queries.
