i have an encistral property at Gadag. in rtc, joint name is appeard.in with my mother. but now a days she combined with my brothers and querrelning with me. they using Ip set, which is in my name. The land disspute is under court. I give complainent to hescom for dissconection of the Ip set meter But the hescom peoples are told, that '' no"' what i can do, for dissconnection of the Ip set current ?

You have two options first approach Higher Authorities of BESCOM, secondly file interim application under Section 151 CPC in pending suit to issue necessary direction to BESCOM to disconnect the electricity supply.

We have got loan for water plant and gave 6lakh to the supplier. He promised us to finish the work within 5days.but he delay it for 1year.before 4months.my father was scold him with wrong words. He recorded those words and now he threatened us to file complaints against us. We are the affected person but he use that recording to file complaints. We already in trouble to repay the loan. Please help us to get compensation from him and how to get out from this verbal abuse pro lem

My kid enrolled for a 3 year tuition course provided by a famous institute on Feb 2015. The entire fees was paid upfront.After a year my kid felt teh curse was not uptp the mark and discontinued on June 2016. I approached the institute for refund on 29 June 2016.After many communications, on 18Feb 2017, they refused to refund stating terms of enrollment. They had another term in the enrollment form which stated I need to seek arbitration before approaching legally. So on March 2nd 2017 I send an email asking for arbitration per their terms mentioned in the enrollment form. They refused to respond. I sent a final remainder asking for arbitration on March 10th 2017 but there was no reply. My query is if I go to consumer court now will I be barred by time limitation (of 2 years) since the cause of action for refund happened on 29 June 2016. OR can I plead for accrued and last cause of action till March 10th 2017 as the opposing party breached their own terms of agreement . OR should I pray for condonation of delay . Please advice . It will be helpful if you can provide any reference to sections of Consumer Act or previous judgements

If someone wants to withdraw before admittance of the case in NCDRC.. what's the procedure like. Does one has to just inform the lawyer or it's so that an affidavit for withdrawal has to be given in the court. If so, any format... may please be shared. The case no has been allocated but the case is pending for some conformity to comply to Section 12(1)(c)

A. Section 12 (1) (c) of the Consumer Protection Act, 1996, deals with clubbing the cases of many people or complainants for similar case. It seems that many people have got the same case and hence it is being waitlisted. In case you do not want to pursue this case any further then approach your lawyer and ask him to withdraw the case. He/She should be able to do the needful.

Sir/Madam I availed road side assistance of tata motors in May 2018. They came with a faulty POS machine for card payment. I didn't know that and I swiped my debit card twice. Because the machine was not responding, I paid the service charges by cash. But, later, I received notifications from my bank that both my debit card transactions were successful. So I contacted tata motors customer service. They responded well initially, but stopped replying to my e-mails and phone calls. So I filed a complaint in consumercomplaints.in. Again, tata motors did not respond well. I would like to know how to proceed with this as a case in consumer court and get my refunds.

A. You can Consumer Complaint in Consumer Forum against that servicing center and Tata Motors company for deficiency in service.It is required to file complaint as early as possible.Therefore you need to get Bank statement from your Bank.And also bill/receipt from servicing center.But you can send legal notice prior to filing of complaint against those.

Sir, I am a senior citizen paid Rs. 4,29,600/ to a builder in 2013 for his proposed apartment which he never started. Later the builder issued me a cheque for the said amount in 2015 which bounced. I had appealed to the consumer forum and on June 2017, the hon. forum passed judgement stating that the builder must return the amount with 12% interest PA. As the builder did not comply with the order, I had appealed for execution proceedings which resulted in warrants against the builder. Now the builder had appealed with the State commission and obtained Stay on execution order of the forum for a period of 4 months. This stay is ex-parte passed in by absence. Kindly advice me how I can get the stay vacated and the execution order of the forum enforced. Thanks and regards K. Shivaram

A. Dear Sir,
You can appear before State Commission and get vacate stay granted by it and proceed with execution proceedings or ask the State Commission to direct the builder to deposit 50% of the amount granted in your favour.

Following the googe ads for the product "Bose Sound Sport Free Truly Wireless Sport Headphones"( actual product reference https://www.boseindia.com/en_in/products/headphones/earphones/soundsport-free-wireless.html) i landed on the website https://startshop.in. I gave an order for the product on this platform on 07-Feb-2019 through Cash on Delivery payment mode. 2. A product was shipped, and i received it on 12-Feb-2019 from courier service "Delhivery", and Rs. 2999 was paid to conclude the Cash on Delivery transaction. After opening the product, i came to know that product was not "Bose Sound Sport Free Truly Wireless Sport Headphones", but something different a cheaper brand headphone. 3. I tried calling the merchant's (Quetailshop) number 9821620168 which was on the shipping label, but got to know that number does not exist. 4. I immediately called courier service "Delhivery" to report the incident, and a complaint was lodged with them (reference complaint number: 1767314). I requested them to give the merchant details, and got to know that the actual merchant's name was "pickrr technologies". They gave 3 contact numbers of the merchant (01149067978, 01141606396, 01140391545), of which 2 numbers did not exist, and on the other one i was able to connect, but, some person attended the call and replied to me that it was wrong number. I reported about this to "Delhivery", and requested them to block the payment to the merchant. But "Delhivery" negligently denied to acknowledge my request and said they cannot block payment. 5. Finally i am unable to trace the source of the fraud and to take any action. I have attached all evidence i have at my disposal with regards to the fraud. Hope justice will be served.

I admitted my son in one of the well known institute in Mumbai for JEE coaching in July 2018 (Allen Career Institute). I paid Rs. 1.50 lakh rupees as one time payment. They assured that they will teach my child properly. But my child told that they are not teaching properly. I told them but they were least interested.My child stopped going to classes from November month. His course will end in May 2019 (JEE Advance exam). I told them to refund the fees but they declined claiming that they have refund policy. But I was left completely unaware of such refund policy (It is mentioned on their website). Can anything be done? I found many cases online. All the news say that refund was done. Court mostly give decision in favour of students. Anyone willing to take my case please contact. Will it be reliable to do case. I have taken admission in chanakya ias academy on 8th august 2018 and submitted amount of 60000 but after taking some classes i realise not to continue and i request the academy to kindely refund my fee but they told me to not refund and they don't have any policy regarding fee refund and they ask me to write an application regarding fee refund and told me to wait untill they get any response from there headoffice and after 2 months they refused that there is no policy of fee refund so don't waist your time then i ask them for leave and they agreed but i don't want to continue with that Institute and i send speed post to the head of academy but i don't get any positive response yet. please tell me what can i do!
