I sold my restaurant good will with all equipments, fittings and fixtures. Also agreed to allow the new owners to take over my online accounts with aggregators like foodpanda Zomato etc. The property was rented and the agreement was done by the owner of the building (he is a lawyer). Since the restaurant is in basement, there's water logging issues. Now, the new owners are threatening me that they will file case on me for water logging inside restaurant and few equipments are not working. However, I clearly demonstrated all items and shared water logs inside while handing over. Adviced them to get the chambers repaired by the building owner. Please advice.

Hi, I have taken a franchise of an online mobile repair portal. While I have paid all charges mentioned in their quotation for starting the business, the support from the franchise has been very poor. I made contact with other franchise of the same company, and found that they all were facing similar issues with franchisor. However, the most shocking issue that I came across was that the person who had been dealing with me as Shaad Rahman had met other franchise as Rahul Verma. We all got suspicious about him and the entire company. I asked Shaad Rahman about his real identity and responded that he would do anything to help his business. His comments are available on a WhatsApp chat. I request advice on if such impersonation is a cognizable offence as per Indian laws? What recourse do I have if the person and the company are found fraud upon full investigation? Shall continue doing business with them? I have not yet signed a franchise agreement with them.

Hi , i am jay from rajasthan and i am starting a new trade firm. I supply agro products to my clients. Client is ready to pay 20% advance against LR copy and pdc cheque/blank cheque for remaining 80% and he is ready to do agreement with signature. For this above term. Is there any problem arise if i do business in this way? Because i am concerning my remaining payment to be secure 2nd- my another client is giving pdc check of total amount aginst LR copy while purchase order and when i will diliver goods they will take cheque bavk and will pay by RTGS , agreement will be done both us , is there any problem if i do business like this way? Please let me know , by these two way my payment is secure from buyers? Thank you

A. Dear Sir, Pease find below answers to your queries: 1. In the first instance, you are inquiring about the problem that may arise in the way you are doing business. In Legal sense you wil not be having any problem till the time you keep the records properly. 2. Secondly, again the query is for business conduct. The conduct of business is kept up to the owner and they shall not be charged till they have proper documents and have maintained the records and pay tax accordingly.

Sir i am having shop in registered co-operative society about only 100 sq. ft. but when i bought it there was no basin, or toilet. i wish to build my toilet outside my shop. i am whole day in the shop. society says that you can build in your shop. but it is not possible due to my small shop. i told society only 8 feet is needed and i will built with my own expenses. but they refused what can i do?

A. Dear Sir, You are permitted to build / construct anything in your premises but not in open premises. If you build anything in the open area you will be subject to action. You can raise your request to the society adminsitration and ask them for consent. If they agree then Ok otherwise you will have to build in your area only.

I lived in a rented apartment. I paid 20000 as deposit when I took the apartment. Now, I left the apartment on 15.12.2017. My landlord asked me to serve one month's notice, which I did. When I asked for my deposit, they asked to clear the electricity bill which was 500. I left that place hoping that he would transfer the amount but he called after a week to tell me that the electricity bill was 17000 and I had to pay. I had already paid the bill and that is what I told him. He remains adamant and says that first I have to clear the bill and then he will transfer the amount to me. What an I do in this case? I have already paid the bill so it hardly makes any sense. Plz help.

Can I file a case against a person for performing a fraud of money in the name of buying me a commercial cab and getting it placed in international call centre thorough a Tour and Travels company, he betrayed me by making me return the slip of 100000 rupees, that I deposited to Tour and Travels in the name of getting me a commercial cab. He took the amount from Tour and Travels company and took around 80000 rupees from me and went to his hometown. The Tour and Travels company handed over my 100000 rupees without my consent and now whenever I call him, he keeps saying, that his condition is not good, he will return the amount, however I know he won't. I have the xerox copy of the slip of 100000 rupees and 28500 rupees is on my account statement, it's been more than 1 year to this incident, I had debt already and because of this guy, I took more debt from market.

Hi, We bachelor left the 2BHK flat in Hinjawadi, Pune. We expect deposit nearby 1 week, but didn't received yet from the owner. Actual rent agreement was upto June 2018, but we have been forcefully evacuated from flat due to Apartment rule that bachelors would not be permitted after 31st March 2018. We left there from 24 Feb 2018. Please help. He said he had transferred last Friday 13th April 2018. We still didn't get it.

I have group of investors who are ready to give me small amount about 4 to 6 lacks for long term and I can use this bulk collected for any investment or business and in return after about 20 years I have to return them amount which is minimum 10 times of amount given to me. I need to know (1) Can I give them guarantee that this many times of their deposit will be given to them after about 20 years (2) Do I require to get any licence from government bodies ? (3) What kind of agreement O need to enter with depositor ?

Hello We hired an interior decorator for our house but never received the legal contract promised and kept on trust as it was supposed to be a short contract. The person worked in bits and parts and took cash payments in advance. Only two small payments have been made online. Now it's been almost a year yet the work hasn't been delivered despite all the payments and just gets postponed on some excuse. Can we sue based on text/WhatsApp message records without having a legal contract? Thanks
