Hello, so i am starting civil contract work. But being a new firm i didn't get any project. So i thought to meet my friend(as he already have firm which works in civil project) . But there is one problem what if he cheats when he gets payment. I may face loss. So what i thought personally is , i can get partnership in his company and by getting partnership i may also get partnership in his company's current account(as a joint account holder) .so whenever he withdraw money he needs my signature. Or second way - we both may have agreement that his company will transfer all the work to my company(as i have new firm) as subcontractor . And will also move all the money to my company's account. Now(1) i want to ask is there any other way ? (2) above methods are applicable ? Any of them? (3) what would you suggest in such situation? (4) what papers i need to make before starting work or what kind of agreement i need to make ? (5) your personal advice to take any step ? Note - i have mutual trust on my friend but in today's time no one is neat and clean ..money makes everyone greedy. Hope will get better solution. Thanks

A. dear client kindly make written registered partnership deed with proper clause with terms and conditions.

My husband is working in private firm from last 1and half year as HR and Admin Manager. Now they are hiring another person on same post and said to my husband that he handover all work to the new appointed person and giving pressure on my husband for resignation. While my husband is saying that he is not ready for resign. According to appointment letter my husband is demanding 3months salary or notice period but they are ready on this point and continuously giving pressure for resign. Please help us

A. Dear client if you are not happy with the separation allowance/money then you have the right to go to the Court of Law or file police complaint against pressure for work.

Let me put you in short that I had rented my flat in Jan this year. A tenant approached me through online advertisement. He paid me two month rent one as advance and other as security deposit. He stayed for two months starting from March to April. On may 12 he messaged me that he would vacate the house due to some medical emergency but had not paid the rent for that month. I messaged him back on WhatsApp that as per agreement he has to give notice of one month in advance and should clear all his dues including MAY month's rent to which he agreed. I approached him in the month of June to clear all dues and vacate the house so that I can place another tenant. He came once in June and agreed to clear all dues. Almost every month I messaged him on WhatsApp and requested him to clear the dues.He always cited either financial problems, job commitments and family issues and kept on asking time for the payment. Yesterday when I again Reminded him of payment he said he will not pay anything except electric and water charges. My point is the tenant approached in the month of May that he would vacate the house and has not paid for may month and wants to adjust the security deposit for the said month and actually vacates the house in June month. He was not available at flat for the June month. As per the agreement he should give one month prior notice before vacating. He initially agrees to pay but at last he denies. What legal action can I take against him? I have all conversation with me in my whatsapp.

A. Dear Client,
First, send him a Legal Notice through an Advocate.
Second Step, File a Case in the Court of law through an Advocate for recovery of Rent with interest, and also legal expenses of the case you have filed.

Hi, Recently I have resigned from a company and moved to same line of business company due to my area of expertise. However, I have been pressurised from my previous company to leave my current company due to non compete signed with my previous company on a 100 rupee stamp paper and this paper says that I can't join the same domain company for the next two years, though I had a very genuine conversation with them and said that I won't follow any unethical practices. Still they are forcing me legally to leave my current company. Now, I want to know if I can continue with my current employer with out doing any unethical work. Also, I have already received my complete release documents from my previous organization. Thanks in advance.

A. Dear Client,
Since you have already resigned and received release documents from previous Employer Company then there is no problem in working for another new company.
But, your Contract with previous company has to be looked in to minutely.
So, best option for you would be to be in touch with an Advocate whom you know or get one through Vidhikarya.com. Your’s is not the first case in India. There might be other cases as well in your previous company
