A. If a criminal case for cheating is filed, he can argue for dropping of section 420 IPC at the stage of plea, and framing of charges itself. if Court does not agree, go for quashing under Sec 482 in High Court.

A. Why should you bother whether it is bailable or non bailable? It is pure cheating. Give a complaint with Police and you will get abck your money at least.

A. With the above 2 sections in the FIR and the accused having left India unless the police take this matter seriously this case does not appear to be having any chance of conviction against him. Don`t get misled about your matter being treated as a ' rape' . Now about some proofs you are having against him, you have to act fast.
