My dad committed suicide, and his nephew filed a 306 against my mom There was my hearing, I became lot of nervous and I was afraid so I just answered the questions asked by lawyers in front of judge, but I have the additional which can save my mom but now no one is allowing me to add the information . Also my dad's nephew has stopped my dad's pension saying that 306 case is filled so we should not get pension. No one is earning at home. We should get our pension. We do not have money. Please help to save my mom and why my dad's nephew has stopped our pension as he do not have right to do that.

A. I wonder as to how pension is connected with criminal proceedings?
It is only at the conclusion of trial the accused can be held guilty or innocent. Till such time she is presumed innocent. Engage a counsel practising in High Court to file a writ to direct to pay the pension.

Anticipatory Bail (AB) issue can be discussed in Supreme Court ? Can Supreme Court reverse the order of High Court regarding Anticipatory Bail (AB) ?

A. If anyone is declared an absconder or proclaimed offender in terms of Section 82 of the Criminal Procedure Code, he is not entitled to the relief of anticipatory bail. SC can reverse any order passed by any HC

NBW has been issued against the accused, FIR also lodged. AB rejected by sessions, moving to High Court now. Question is once we file the AB in High, so during the proceedings (hearings) for this AB, what is the legal status of the accused, is police still looking to arrest the person; or they will wait for the result of AB by High Court.

A. police will apprehend him during the pendency of AB application unless otherwise HC grants AB. Mere filing or pendency of AB application does not mean AB has been granted.

Lower sessions Court has rejected Anticipatory Bail in Rape and Abortion IPC, we are going for High Court, what are the chances. Please advise. NBW has been issued against accused already way back now.

A. Dear Client,
As your case is cognizable for the offence, you should without any delay get it file for Anticipatory Bail at High court.
See, possibility of getting AB depends of allegations, imposed in FIR; And ground taken in AB Application, and the court's view in which case listed . You may consult for the same for draft of AB petition and for fling and arguing . Pls Rate / review , Thanks
