1 year back 498a complaint got settled with mutual divorce, in police station, with both parties agreement. But FIR not filed. Then applied for divorce and since that time we are not living together.


A. husband not interested on mutual divorce means it was because there was huge alimony for settlementand agreed for mutual divorce to avoid 498A.
new 498A can be filed again by wife.
old 498A complaint, mutual divorce petition all will be important in case.

A. absolutely no need to go to court in pandemic.
Court can issue arrest warrant. In our cases we got issued arrest warrants for not only witnesses and even inspector itself.
court case can wait if it waited for 4 years.
you can give a application/affidavit for the same.

A. if not registered then individual share is still not decided.
the documents can be used to settlement of share but have to be analyzed.
Civil court have to take decision on division/share of property and until then no construction can be done.
