Can I ask opposite lawyer to refresh my memory about allegations on me in a criminal case during the cross-examination?

Posted 3 months ago

A. Hi,
Cross-examination is used by the lawyer to gain control over the witness and force the witness to answer questions that are harmful to the opponent's case. It is a procedure in which the lawyer asks questions and the witness responds; nevertheless, you might request that the lawyer refresh your recollection.
Thank you very much.

A. Hi,
Anyone who creates or publishes any imputation about any person with the purpose to injure, or knowing or having grounds to believe that such imputation would harm, that person's reputation is said to defame that person, according to Section 499 of the Indian Penal Code (IPC). You can file a complaint under Section 504 of the Indian Penal Code, which states that "intentional insult with the purpose to incite a disturbance of the peace" is a crime. Posted 3 months ago

A. Hello Sir
This is not a valid ground to call the case of 498A invalid. You have to find much stronger ground to file a petition under section 482 of CrPC to qaush the criminal proceedings against you in the case of 498A. You'll have to first gather evidence that states that the case filed by your wife is false.
Thanks

A. This happens.
Ask court orders for phone records from mobile company.
First get him declared absconding from court.

After that there are 2 scenarios

If he not left India then his passport and travel can be hold after court declares him absconding.
Same orders will be sent to US embassy as well.

If he left India then its almost impossible to bring back.
But can be arrested after landing back in India.

A. Dear client,

Whenever there is a show cause it is always a rule to submit the proper reply to such showcase. You also need to appear before the said authority, avoiding it isn't a good idea.
Whatever is your clarification, get it drafted as a reply by an advocate, and submit . Do mention every detail, about how you were unaware of the case.
If found satisfactory, the authority will take steps in your favour.

Thank you

A. Hi,
The court can't order your boyfriend to marry you. Marriage is not something one can do without his/her consent. Legal notice can't be sent for marrying you. Please approach a lawyer only if necessary.

A man sexually exploited me under false promises of marriage. When I filed a complaint, the police facilitated a compromise to marry instead of registering an FIR. But then he refused and went missing

Posted 3 months ago

A. Hello Ma'am
If the police are not putting section 376 in the FIR then you could file a complaint to the magistrate and as well as the senior police officers of the police department via a letter.
Although there have been judgements recently stating that sexual intercourse on fake promise of marriage is not rape.
Thanks

A. Hello, The phrase indicates that if the court finds you guilty. The word "conviction" implies that the court has declared you guilty, which is not the case yet. As a result, there is no chance that you will be denied a passport.
Thank you very much. Please give your opinion on the response.
