i have taken loan from private NBFC 150000 2018. now i have paid all emi till date. maximum emi paid by cash to lender. now lender says you have to 42000 more for late payment charges.

When you paid the EMI in cash then did you take a money receipt from the lender as a proof of the payment being made? If yes, then calculate all that you have paid and see if still there are some pending amount or not.
If you not taken the receipts then its a difficult situation to prove that you have paid.
Lend money -without paper work
I have given money to a person without paper work but with cheque.He is now not returning money. Is it anything I can do legally.

A. To give opinion, it is necessary to know when you have paid that cheque to that concerned person and whether there was any verbal understanding with you to pay interest upon that sum. Please take note that until and unless you give him proper demand notice for refund of that sum along with interest or not, then your claim may become time barred by efflux of time and then it will not be possible to file Money Suit.

You will have to create the evidences showcasing that the brother has taken loan from your wife by sending him a legal notice and showing the banking transaction. Once you are able to do that then ask him to repay the loan.

Keeping PDC is good option as security but it depends upon whether you and the concerned person have kept any physical contact or things are completely taking place online and such terms are usually specified in the agreement and should be included and also clauses pertaining to disputes and where and how action will be initiated in case of dispute etc.

A. Hi,
You don't give the money unless until he shows you the proof. If he threatens you, please file a police complaint. You can sue him in court for mental harassment and criminal intimidation under IPC. Please contact a lawyer.

A. The rate of interest @6% per month is very unreasonable and against public policy and law. Report the matter to police for harassment and file suit for permanent and mandatory injunction against him. Through court resolve the matter.

A. Hi,
Yes, he is eligible for a government job unless the nature of his job is such that it has to be done by a person with no liability or any such encumbrance. If there is such a condition, it would be mentioned in the job notification and otherwise, he is eligible.
