hello my marriage going on 5yrs ago and I have 1child he is 2yr but after marriage startings I'm not happy and mentally depressed and feeling tied and alone because of my husband not support and respect me and not going to me outside with him and not alone and my choice my dream no value for him he is not given time to me come to late at night and drink daily but I am try to live with him but because her parent but he is not understand and listen to me I have only with him my child but I have decide to quit him but he is not give me mutual divorce but I am not love him and not feel him because he is tortured me mentally then I have not feel him please suggest me

A. Dear client kindly File a divorce petition on the grounds of cruelty
Also file a petition under Domestic Violence Act
And also file case for maintenance

I am 31 yr Hindu male.1.5 yrs of marriage. Wife left home 9 months ago . I put RCR application. Court asked her to put her statement on next hearing.She is doing BAMS undergraduation. I am doing my post graduation. I have stipend (not salary) of 10000 per month. If she asks for maintainence- 1.how much amount will court order as I need at least 10000 for my daily expenses in metro city. 2.for what duration I have to give maintainence. 3.will I have to give money for her education or only for daily expenses and travelling because she is in private college and she took admission before marriage and I can't afford that. 4.only my income is considered or my family's income also considered??

I married 1.5 years back and its a complete arrange marriage. but my wife is not turning on to me. she prefers to stay with her parents. she has stayed all total for 4 - 5 months in my house. I had cleared before marriage that she has to stay 6-7 months in my hose to learn how we live. As i am working in Kolkata so i tooked time to arrange home and all facilities to run a family, they agreed on this. But after marriage she is not allowing me to touch herself. I had tried many time but she moves away and day by day she has turned so rude that now she blames all my family that all have scolded and abuse her like anything. But no one has done anything as i have father and a younger brother we both married together on same day. My mother died long back in 2009. I had shared all the things that my wife have done with me she has abuse me like anything and i have made her understand many a times but she replies "main apne maa baap ka nahi sunti .. aap kis khet ki muli ho" .. she shouts like hell in home and many more. Due to her behavior i had asked my father in law to take her home. and since feb,18 she is not in my home. As of now my father in law is saying that i have not said any thing regarding their daughter deeds. I don't want to stay with her as they have said by consulting a doctor that i am impotent. I am a science graduate and related to medical field i don't have such lacuna. Please guide me

A. Dear client unfortunately there is no men protective law. You need File a suit against your wife for restoration of the conjugal right under section 9 of Hindu Marriage Act 1955. If she deny to live with you then file a suit for judicial separation.

Hi, I filed divorce case and then my wife filed RCR + interim maintenance petition and included a fake courier receipt to show that she sent lawyer's notice before my divorce petition to prove that my divorce petition was in retaliation to her lawyer's notice for RCR. Is it the case of prejury ? Can a section 340 be filed ? Can we get RCR and interim maintenance case dismissed ?

I want divorce from my husband. I have two daughter, one is 5 years old and other is 1 year and 2 months old. I got forcely married at the age of 16 and my husband and his family makes false documents in which they showed my age 18 uears but i was 16 years at that time. I suffered lots of harrasment and voilence in that family. I also faces physical harrasment. Now 1 am 23 years old. I loves a guy but i didn't make any physical relation with him. I have a step mother who not loves me ,it is the reason that my parental background is not good. I want a divorce and my little baby who is 1 years and 2 months old. My husband always hurt me physically and making only physical relation. Please advice me how can i take divorce and he is not ready for divorce.

A. You first need to collect evidence that you were a minor at the time of marriage. This is can done by obtaining your birth certificate from Municipality/Corporation which has the actual date of birth. Thereafter file an application of annulling the marriage. As for custody of the child and maintenance, you will get order from the court in your favour. In the meantime you can lodge a complaint with the local police station for domestic violence and 498A IPC and Child Marriage Restraint Act.

Respected Sir/mam, I have been married since 3 years. Last year July i got to know that my husband was having an affair with his colleague from the very next month of our marriage. Last October he broke-up with her after lots of drama from the girl's side. ANd took the decision to do navy job. I asked my parents for financial help. They gave the entire course money. Now the condition is that i have been working from last 9 months since he isn't working. And he is staying with his parents in his village leaving me alone here in kolkata. His mom is a witch, she usually brain washes him to remarry & divorce me. And he is totally a mama's boy. Since one month he has not returned from his village & neither msgs or calls me. Sir,i have got married in Feb 2013,after marriage my wife being always trying to fight and ready to live with her parents,this process was very frequent and in 15 sep 2105 she completely started to live her parents house except on diwali occasions she came for 1 day now after 15 sep 2015 she came back in 12 sep 2018 and still I do not know how much time she will staty ,she is also not allowing me for physical relations and the result is that we do not have any child till now ...she is very cruel,emotionless and my life is completely disturbed ,now pls suggest how to separate.

A. Dear client if your wife left your house and deny for cohabitation then you can send legal notice through lawyer or file divorce case on desertion and cruelty grounds

Mine is love marriage but accepted by both side families. We r having 6 years old SON. After 5 months of marriage my husband started blaming silly things ...not cooking well not doing house hold things well even if I do those things properly . He did not believe me after showing proof also . He does not like discussions...resolving issues. He did not show initiation for family life ... whenever I ask why you r doing like this he blames me for that also.i patiently waited ... once said give me divorce Out of frustration. Then he started asking me for divorce. I think he has some psychological disorder. That's the reasion he was unable to understand and think . Believe things in practical and really like other normal people do. He used medicines for that.we took my money and not returning back .now he is saying he will not give mo ey for my son n myself. Can I prove his psychological disorder in court ? If yes can I get benefit from that ?
