Sir my brother marage had got separated in front of village head n legal officer. My brother n his x wife were signed in papers that they accepting the separation. We have given them all items what ever she bought from her house. It has been 6months of separation. We want to start my brother new life with new person so we want to decide to get married to him. But we have a dought that after my brother 2nd mrge if 1st wife comes what we should do. What steps we have to take for getting problems in future for new girl who comes to our house to protect her n to keep strong their marriage life fother...pls give us an advise to keep my brother happy..

My husband got involved with another woman and threatened to divorce me when I asked him to cut off ties with her. After a lot of fights and trauma I got fed up and we separated as he wanted. After separation I informed the woman's family about her and my husband. Now my husband is refusing to file a divorce because I told her family and does not want to live together as well. Im stuck in between. What do I do?

Hi My husband had filled a petition of judicial seperation section 10 of hindu marriage based on cruelty as mentioned in summon. I am living with him at his home with having a baby girl of 1 year. I don't want to give divorce or seperation to him. So Is this easy for him to get seperation through court.?? Also wants tò know that separation and divorce are similar ??

A. I beg to differ in the matter of evidence. Evidence is very important in Law, family Courts are no exception to it. If your husband proves cruelty he will get a decree for judicial separation. But judicial separation is not divorce.

My sister got divorced couple of years back. both she and her husband are officers in Indian Army. There were two flats which they took on loan. both were on her husbands name and he pays the EMI with his salary while they used her salary for all household and other expenses. 6 months prior to divorce during settlement, they agreed (on a legal paper) that one of the flat will pass to her. it could not be transferred immediately as it was under some army scheme and need to be registered in Husbands name first upon completion and only then it could be transferred to her. he has been stalling the registration since couple of years on some excuse or other and has got it registered in his name now and refuses to transfer it to my sister. On the final papers during divorce (6 months after the settlement agreement), they mentioned that all the settlements are done (though the flat settlement was not done as it was not complete for property registration ). All the legal proceedings were done by husbands family lawyer who represented both the parties and not sure if he did it intentionally. My sister did not have any legal contacts and signed everything on good faith as didn't expected this. Now there are 2 legal papers, one pre-divorce settlement (6 months before divorce) which says that she will get the flat. Other, final divorce paper which says that all settlement is done. Can she file a case of cheating to get her rightful share what was agreed during pre-settlement? What are her options? Kindly advise. Thanks,

My in laws brainwashed my wife against me and filed divorce under mutual consent but nw my wife regrets but nw her family threatend her for do nw i have 5 months left for the hearing .what should i do? Is 6 months fixed for mutual constent divorce?

A. Sir in mutual Divorce , on 2nd motion that u tell in front of the court that I don't want Divorce... And even my wife don't want Divorce but her family members r forcing her to take divorce...
On that day she will also will be there in front of the court.. u will also will be there in front of the court... So once u give this statement that we both don't want Divorce... Then judge will ask her too.. if she will also give same answer then Divorce petition will be dismissed...
But that is the last chance for u both .... U both have to tell in front of the court that u both don't want Divorce....

Sir, I understand from different means if a man says I want to get separated from wife all parties point the man and make him understand and unite with his wife. But why there is no law for man who want to live with his wife. My story is my in-laws corrupted my wife and separated her from me. She is not that matured to understand their game. Now I am the one who suffer and also they made her to leave India and work in Bahrain in a Place where no man would like to see his wife. For their carving for money why family life should get affected and what is the legal proceedings I should take. Hi, I'm seeking divorce from my wife. I earn around 1.2lc per month and having 65lc of home loan with Emily of 56k. We have a son 6 month old staying with my wife with her parents. I want to know how much monthly maintenance I would be paying her.

A. The Supreme Court has set a benchmark for maintenance to be paid by a husband to his estranged wife, stating that 25% of his net salary might constitute a “just and proper” amount as alimony. The apex court’s ruling follows its inclination to protect claims of women in matrimonial disputes affecting their financial status. “A Hindu woman’s right to maintenance is a personal obligation so far as the husband is concerned, and it is his duty to maintain her even if he has no property... . It is well settled that under the Hindu Law, the husband has got a personal obligation to maintain his wife and if he is possessed of properties then his wife is entitled to a right to be maintained out of such properties,”

I got married in hyderabad in 2008 through Arya samaj and it was a love marriage against family and the marriage was not court registered after 1 year I got to know that she is a character less women having illegal physical relationships with different mens and when i console her abt this y u have cheated betrayed me then she said that from early days she used to do this and but even after this i forgive her and given a chance to correct herself but she didn't and doing the same again and we have a kid of 7 years and unfortunately I was met with an accident in 2014 and i had a serious head injury due to which my body got paralyzed and im on bed completely and even after this she didn't even came to care see me and later she said she will keep kid custody with her life long and now from 2014 to till date we have no relationship and living separately and she had all arya samaj marriage certificate and photos with her Please advice can I get marry with another marriage

A. I don`t understand how you are thinking of marrying again when you are paralysed. Anyway, if you file for a divorce, you will come to know her re action. if she refuses, ask for maintenance from her.

My wife filed a case against me, after living separately for 11years.She is doing a private job with 1.5 lacs/month salary. She filed for divorce and one time settlement. I attended the court in the first summon. Since then I was never summoned or informed about the court proceedings or dates or even about the final judgment/decree.Now I received a summon after one year, as to why I didn't pay the sum of 10 lacs as ordered by court .

A. Since you already attended the court after receiving the summon, you should have kept a follow-up either by yourself or through an advocate. Ignorance of law excuses no one. Since you did not contested the divorce proceeding by filing w/s your defence was struck down therefore ex parte decree for divorce and maintenance was drawn and passed. Now you need to get the copy of the decree from the court. You might have to approach the high court for appeal/revision and also file a condonation application u/s 5 of the Limitation Act. But be clear, high court might impose exemplary cost for condoning the delay. But that is the discretion of the court, it might not also impose any and allow your condonation application, depending on the grounds of delay and other circumstantial facts.
