A. Dear Client,
Following are the grounds on which you can file for divorce against your wife under the Hindu Marriage Act, 1955:
1. Desertion: Since your wife has abandoned you and left the marital home without any reasonable justification , and has not fulfilled the marriage obligations.
2. Mental Cruelty: Since your wife made false allegations against you, constantly demanded for money and denied you a physical marital relationship
Hope this helps.

Thanks

A. This is not a legal query. Your mother in law has asked you to pay for the daily expenses of your wife and your child in such sensitive condition where your wife will not be able to work for few months and baby needs utter care and your wife will need some female attendant to be around if needed so there's nothing wrong if your wife is staying at her mother's place for month or two in such condition. You should be paying on your own instead as much possible from your end towards maintenance of y ...ReadMore

A. Dear client,
She can only say no to a mutual divorce but does not have any right to file an additional case on the basis of the divorce case filed. She may file additional cases on the basis of false information such as a section 498A case, but cannot file any legitimate case against the divorce.
Thank you.

A. Putting pressure on husband for alimony is not legal and there is no provision in the law for anything such although you may demand any particular amount of alimony. Anyhow if you have property gifted by him in your name absolutely than it becomes you self acquired property which you do not need to give him back against your choice but in case you want to keep things peaceful and move on from a wrongful relationship then you may ask your husband to give you that much of the amount of the propert ...ReadMore

A. You can file the RCR as well as maintenance even today without waiting for the dismissal of the case. In fact you should file the RCR as soon as possible as that will make your case stronger against your husband in divorce matter. If your husband is able to reopen the case and take it further then it will be problematic for you.

What is the rules in case wife is residing in her parent's house away form husbands house 2000km or she can shift to foreign after divorce

Posted 3 weeks ago

A. Dear Client,
The wife is free to live where ever she wanted to reside after divorce even in the case if maintenance is to be given by husband. In Divorce cases where wife do not have proper place to live she can legally stay in matrimonial house.
Thank You.
