Do we have any law on which medical ground any spouse can take divorce ? Suppose wife is keeping unwell and she need care and proper treatment but husband has never given any money for her basic needs

A. She can file a case under 498A(Domestic violence ) in the nearby Police station or can approach court for divorce under mental Harassment and cruelty along with alimony provided there should be proper evidence to prove it.

A. The court will give you certain period of time to appear and answer for your husband's complaint, if you don't appear even after that time then the court will set you as an exparte and grant the relief what your husband has asked in the complaint.

You can definitely file a divorce petition and or may send a legal notice by visiting an advocate for the same. If your wife is not interested in the marriage or has left without saying anything go for mutual divorce.

A. Hi,
Mediation is necessary before taking the divorce case to the court. You can either go for Mediation through courts under section 89 of Code of Civil Procedure or Private Mediation. Try and resolve your issues at the Mediation Center.

A. Hi,
File a petition for restitution of conjugal rights. You can then try marriage counselling. In the meanwhile, file a petition for interim maintenance under Section 125 CrPC, this will allow you to claim a monthly amount from him to support yourself.
