HMA 9 order is done.we both compromise in court.court clearly instructed to her bring back her crpc 125 and DV cases from court and bring dowery complaint from police station (498a FIR not done). Court order is done.but she not took her cases 125, DV also not took 498a complaint from police station.....Dear sir/ma'm plzz guide and suggest me how can I save maintenance....She has no any kinds of evidence. A.she filled 125 case on ground dowery demanding by me and family..But 498a is not done according to HMA 9 court order copy

A. Dear Sir,
It is for her to get compliance otherwise you may file a contempt petition before HMA 9 Court.

is it possible to get divorce after 2-3 days of wedding if only wife want that

A. Dear Sir,
Normally divorce petition will not be entertained within 1 year of marriage unless exceptional grounds like medical etc., are brought on record.

I did 125 crpc in sep 2018.so my husbund was ready to give me some amount. In March 2019, I did agreement that i will give divorce n withdraw my 125 crpc case with half of total amount.so my husbund gave me half amount. Now i dont want divorce ,so my husbund asking for returning money. He is ready to fight in court. I want monthly maintance. If i return his money back , how would i get maintanace ? From which date i will get maintanance ?As i have already withdraw my 125 case , from when i get maintanace? What can be leagal step or aargument ?

A. File a suit for maintenance.

Dear Support, Family court Jhansi Has given decision to contest divorce on merit by applying penalty on them thus set aside exparte order (Ordered Earlier By previous Judge) They have not given any sufficent cause for non appearance but instead prayed to give them chance to contest, Judge was not agreed and some how given last chance by applying penalty. In this scenario can I appeal/Challenge in High Court for they had not given sufficent cause but prayed to give them one chance.Date of exparte order is 03/01/2019 and date of exparte set aside exparte is 28/08/2019.(Thanks & Regards)

A. Yes, absolutely they can live together, it's their wish.
but there will be no legal right between them
it will be just like living together

Hi, i am a mother of 2, a girl and boy. I have had a roller coaster marriage since beginning, i even left my house twice. But came back for my husband. My mother in law is an evil lady she has troubled me a lot in the past but now matters have gone from bad to worse. She talks about sanskar and all but teaches all wrong things to my daughter who is 2.6yrs old. She pampers her to the extent of spoiling her and letting her do wrong things. My husband was in depression because of his earlier failed marriage and now has anger issues.. which i am scared will create a bad impression on my children's upbringing. Although he is educated, but still doesn't understand what his mother is doing to us and our family. She is an evil lady and cannot talk good about anyone. she interferes in my child schooling as well.. I cannot bear it. I love my husband but i am stressed because of her and i am unable to come close to him as well. But i feel like getting out of this hell hole and save my kids future. Also, my husband is the only child so we cannot stay separate. please suggest, should i divorce my husband because of my mother in law.

A. Divorce is not advised,
rather, file a domestic violence complaint against your husband and mother in law for causing mental, emotional, economical and physical abuse to you and claim residence, protection and maintenance order,

I want a divorce from my husband,he ii treats me and calls me names which are too painful for my ears.We have a home in a joint name.My father funded the house and now my husband is just paying the loan.Since I am not working,I don't earn and am totally dependant on my husband's salary.i will need alimony and a place to live.I require legal advice.please help me

A. You can file a divorce petition before the court on the grounds of mental cruelty. Along with it file another case under sec 125 crpc claiming maintenance.
You can also make a complaint at the nearest police station under sec 498A.

My wife presently not talking or respecting my parents. She is stubborn and pressuring me to leave my parents. She has also ircureable medical complication which was hidden before marriage. Now if I want to get divorce from her in contested way will it be feasible and also If there is a chance to win the case in low alimony I am ready to file the divorce. She is working in a private school her qualification is b.sc, m.sc, b.ed.

A. Yes, you can file a case for divorce and as she is educated enough, she won't be provided much alimony.
