I applied for mutual divorce in April. Both of us are working in multinational companies(software engineers). And I have gone for an advancement petition and got the six months waiting period waived off and got the divorce decree from the H'ble court in July. Both of us are present in the court and got the divorce. As she is working there was not permanent alimony given to her and we have MOU signed regarding the same. Now she has raised an appeal against me in August in the same court asking for cancellation of the divorce. As of now I didnt receive any stay from the court on my divorce decree. At this stage as it been already 4months since I got the divorce decree can I get married now. Can you please advice.

A. Dear client as per civil procedure code , there is no appeal for the decree passed with mutual consent of parties. Even though if your wife choose to claim for maintenance or permanent alimony it is not possible by law after passing decree. If if she files appeal , her appeal will be dismissed. As the Hon'ble court has passed the decree in the month of July , then you can marry now, no impediment for you.

My husband applied for divorce. I dont want to give divorce. He says to everyone that anywat i no need to give her maitainence. So i can leave her easily. He is money minded. So his parents and he will mould if judge allots maintainence for him. My inlaws says that i had no right again st him. Inlaws feel that my dowryand gold are equal to one flat i have bought aftrer marriage. I only paid complete EMI for that except downpayment for which he paid 4 lakhs. He recently sais to people that hardly 5000 maintainence will be there as she applied for divorce. But mediators said tgat judge allots 30000 maintainence. I canr leave job as it will completely pact my life. He is getting 1lakh and i am alao getting 1 lakh salary. How can i get him back

There is no law to maintain the working women/wife by her husband after divorce.

Sir v got love marriage in 2016. After that we both are not in contact because of some misunderstandings. We are hindu. Now i dont know where is that person. Now i want to marry any person and setle in my life in future. Without knowing anything about him n his details how to solve my problem. And how to delete that regester marriage certificates. please help me to find a solution to change my life

A. Dear client you can file for the divorce in the ground of desertion and cruelty. If you don't know his addreess , then you can put his last known address in petition. If he failed to appear before court, court will pass ex-parte divorce petition. Once the marriage is registered , it only be cancelled by court divorce decree. No other solution , you are seeking for.

Sir / Madam, Already i had applied for divorce...and went to mediation.. there husband agreed will take care all the responsibility..will not harass and compromised (re-union) and signed for the agreement.stayed with me for 3 months and again started hitting me and sexual harrassing...me..owner asked us to vacate the house and i am staying in moms place..he is torturing me sending sms...and i will not leave you..you should come to court with your daughter..every week you should call and come my daughter to court...like that he is threatening me. and i not financial strong.. please suggest me what can i do how many years it may take to decide.

I am relationship with a my girlfriend from past 5 years and we both wants to marry. But my parents forced my marriage, including the girl's family members. The girl's family beat me up and I was afraid that those people would not kill me, so I kept doing as they said. Despite being aware of my relationship with my girlfriend, the girl's family members forced me to marry their daughter. I have been married 5 months The girl lives in her mother's house only. But I met him 2 times in these 5 months because my mother health was bad those days and she was emotionally blackmailing me. Just for my mother's happiness I went . But I don’t have any physical relation with this girl(my family choice). I want to know can I file an invalid or void marriage case now also?

You can file but you cannot succeed as you yourself deserted her saying that your mother health is not good.
It is better to continue the marriage or she may file multiple cases and put you behind the bars.

Hi sir, I want to know if a person is earning 75,000/- per month then how much a court decides alimony at the time of divorce. I m 29 yrs and have a 2 yrs old son. Plz advice ... alimony calculation of judge as per law.

A. Dear Client,
There is nothing as such defined percentage for fixing alimony, however, generally court fix according to living standard and liabilities e.g., if any child as yours, hence in your case should be mini. ₹15000/- to maxi ₹25000/-, if his other liabilities are therefrom his family members, then amount may decrease.

HMA 9 order is done.we both compromise in court.court clearly instructed to her bring back her crpc 125 and DV cases from court and bring dowery complaint from police station (498a FIR not done). Court order is done.but she not took her cases 125, DV also not took 498a complaint from police station.....Dear sir/ma'm plzz guide and suggest me how can I save maintenance....She has no any kinds of evidence. A.she filled 125 case on ground dowery demanding by me and family..But 498a is not done according to HMA 9 court order copy

It is for her to get compliance otherwise you may file a contempt petition before HMA 9 Court.

is it possible to get divorce after 2-3 days of wedding if only wife want that

A. Dear Sir,
Normally divorce petition will not be entertained within 1 year of marriage unless exceptional grounds like medical etc., are brought on record.

I did 125 crpc in sep 2018.so my husbund was ready to give me some amount. In March 2019, I did agreement that i will give divorce n withdraw my 125 crpc case with half of total amount.so my husbund gave me half amount. Now i dont want divorce ,so my husbund asking for returning money. He is ready to fight in court. I want monthly maintance. If i return his money back , how would i get maintanace ? From which date i will get maintanance ?As i have already withdraw my 125 case , from when i get maintanace? What can be leagal step or aargument ?

A. File a suit for maintenance.
