You can file a case for restitution of conjugal rights against husband and domestic violence against concern persons who are creating disturbance . Simultaneously claim for maintainance . Characterassasination is also a ground of cruelty so if they accepting and taking it a ground then you can also take this ground as torture ground against you.

If you want to proceed with the divorce you should hire a family lawyer for this and reply to the notice and if you do not want divorce then you can try settling it amicably with your husband.

Whether you employed or not at least minimum of rupees 5000 may be asked to pay to your wife as maintenance. If she did not appeared then you will get ex-parte divorce decree.

A. No, you cannot file for annulment decree since there is no fraud. The best option is to go for divorce.

Your problem is not divorce but get rid of your wife as soon as possible, If she is not agreeing for divorce then you have face the court . You have not mentioned your marriage period. If she file case against you then you have to face the consequences. As a human being I advise you to sit together or with elders and resolve the issues.

You can file NC complaint or FIR if u your husband has physicallybassualted u and you required medical attention, u can also approach women welfare cell available then u can proceed for domestic violence case if u desire however what your husband is doing totally wrong and illegal and laws are made for such grievances only if you take a step forward....for further help take assistance of an Advocate

A. first you need to take decision whether to adjust with her or to proceed for separation. If you need to adjust then you can proceed with relief from court under restitution of conjugal rights to compel her to stay with you if she does not stay with you . if you want to separate from her then you can proceed with divorce petition and seek relief before court.
