There is no direct benefits to her and infact she is the looser in this especially the DV case wherein she would have got some monetary (maintenance) benefits at least the interim one. In my opinion she might be disinterested to pursue the case when all the facts and evidences are in your support.

If you also feel that you guys should be divorced, then you can file for Mutual Consent Divorce and send notice to him if he and the court will give exparte order of divorce even if you are not hearing the matter in court. In normal case there should be not much problem. In law an accused is presumed to be innocent till proved guilty. Mere pendency of criminal case against you should not be a problem for joining. Government cannot cancel appointment of candidate on the ground that 498A or a criminal case is pending.But you must mention that you are involved in a 498 A case as suppression may create further problems. Just mention about it in your application.
