Legal advice for a divorce - planning to go abroad
I'm planning to go abroad. Me and my husband are not in good terms. If at all he sends a notice, how do I deal with it. Should I travel to India if i am called for?

If you also feel that you guys should be divorced, then you can file for Mutual Consent Divorce and send notice to him if he and the court will give exparte order of divorce even if you are not hearing the matter in court. Or you can seek recourse in the foreign court just like other citizens of that country.

In normal case there should be not much problem. In law an accused is presumed to be innocent till proved guilty. Mere pendency of criminal case against you should not be a problem for joining. Government cannot cancel appointment of candidate on the ground that 498A or a criminal case is pending.But you must mention that you are involved in a 498 A case as suppression may create further problems. Just mention about it in your application.

You have a valid question and since there is no law as such to hep you out in this scenario my suggestion would be to knock the door of the Hon'ble High Court so that the court can pass a judgement that husband's name is not required for divorcee lady. This will pave the way for many in Indian society.

If your husbands would have gone in appeal to hon'ble High Court then be assured that you will be served a copy of the appeal application ( summon) to appear in the court. Without that the court is not going to hear the motion.
The way you have checked online is the way to check. You can wait for the summon to be delivered to you.
