You have to show not only that there was a material misstatement of fact, but also that it was done so willfully—that the person knew it was false when they said it.

Yes you need to file a separate case for domestic violence, as the previous suit dealt with divorce. The court can pass an order in the absence of your in-laws or husband. If it is in your favor you will receive the appropriate remedy.
