Brother not behaving normally supported by my mother everytime he has or does attacks and gets away laying the mothers old age card to save him . My life has been put upside down and I have to keep rebooting myself and get to gear a lot of negetive comments about the same . In 2016 , once again my brother misbehaved ( in depth of the case later , on selecting a lawyer ) I need a way were He can’t escape and evidence speaks for itself I have visited police stations several times but there again my mother backs him up last time he attacked my fiancée n me in 2016 my mother begged not to get him behind bars and then again she sits relaxed saying nothing happened move on and started to lie there on nothing new that I see her doing since my dads death , this guy was forced by police to put him under treatment but my mother found a way to say no he is normal etccc . I have to exert a lot to save myself from attacks and abuses etccc . He acts very normal outside in public and in society though my immidiate neighbour has seen him misbehave . He knew I would have to walk out to save myself and used that time to vandalise my room my belongings n my original educational n work experience certificates No I don’t want this guy to get away the police said install cameras in a way were they can’t be medaled with etccc I need someone with expertise. I need someone who understand this kind of over smartness and can deal with my mother in a way where she says ok to the consequences once and if caught n won’t be allowed to be protected by her Ever Again

A. for hidden cameras, you can do online shopping. For installation of hidden cameras do google search for the expert. In the meantime lodge a complaint for criminal intimidation and domestic violence against your brother.

A. your jewellery and other staffs are your streedhan which includes gifts you received during or after your marriage. Send a legal notice through an advocate, mentioning in details about those articles and the day when you will visit bangalore to collect those articles in the presence of your advocate. If they don't release your articles when you're in Bangalore then lodge a complaint with the local police station. When you will be filing for divorce, you can mention of the same for the refund of those articles in your divorce application

A. file an application u/s 125 CrPC for maintenance for your 2 daughters. You can obtain a decree of for dissolution of your marriage on the ground of cruelty i.e his indulgence into sexual relationship with other women under Dissolution of Muslim Marriages Act, 1939, Note: you should refer your case to the qazi (judge) so that he can correspond with your husband and order him to return. If he does not return, then the judge may rule as he sees fit, either divorce or annulment of the marriage.

A. please share the case detail which you had filed in the year 2015. In the meantime you need to contact the Indian Embassy of the country in where your husband is residing and get documentary evidence to prove that he had remarried out there. Who is the second wife, an indian national or foreigner? If you have not filed a case against your in-laws, then you should file a case for domestic violence against them for throwing you out of the matrimonial house in India. I got married to a guy at March, 2018 through newspaper ad, after ten days suddenly he went to Canada for his job purpose and told me and my parents that he will bring me after two to three months. But after going he stopped contacting me, started avoiding me, his father started torturing me regarding dowry, molested me each and every day. I filled 498a against husband and in laws. During this period can I file for divorce and claim damarige?

A. since yours is a recent marriage you need to wait for a year unless you can satisfy the court of exceptional hardship for filing a divorce case. If you file divorce case now then your advocate needs to take leave from court for admittance for filing the divorce case and satisfy the court of exceptional hardship.

A. Lodging a complaint under domestic violence and 498A IPC is very common these days and does not amount to internal departmental enquiry. Such complaints under domestic violence empowers the woman to live with dignity and gives protection from any sort of violence. Both parties will be call for counselling and a report will be set to the Magistrate. If during the counselling he assures in written not to carry out his violent behaviour then withdraw your complaint.

I am married for 6+ yrs. Having a 4 yr child. child has continental birth defect and 4 times operated. My husband and i stayed for 5 yrs. And staying apart for more than 1.6 yr. Husband didnt pay any maintenance for us. He didnt pay anything for our child towards his education and medicals.i have all proofs. And inlaws demanded dowry after marriage , i have proofs like account statements. I was beaten by mother inlaw. My husband didnt listen to me from beginning. He does what his parents says. I was ill treated by his parents. Although husband stays in another place where he works.i was staying with my husband and son. I was kicked out of home by my husband. I have filled dv case. But the intreim maintenance order by the court is nt even 1/3 of his salary. And no education and medical fees are mentioned for our son. I am paying his school fees and medicals with the help of my parents. I am staying in a rented house and rent paid by my parents.my rent is also nt covered properly in the intreim order.Husbands salary is 1.4 lakh per month. And i got only 27000 as intreim maintence.child is 4 years with sever medical issues. How to cahallenge this in upper court and how much chances for revision. I want to saty with my husband as we have 4 yr child.husband is forcing to stay with inlaws instead of with him. I was tortured a lot by inlaws beaten physically ,harrassed mentally due to their unwanted dowry demands and slang words.i dont want to stay with them. inlaws wants divorce. Does filing RCR will help in this case??

A. As per the new ruling of the Supreme Court wife entitled to get 25% of the net salary of the husband. You can file a revision petition before the high court for enhancement of the maintenance. You cannot force your husband to leave his parents as it will later become one of the ground of divorce. For dowry demand, lodge a complaint with the local police against your in-law under the dowry prohibition act, 1961 and 498A IPC.

After my husband's death on 12-04-2018, my in-laws put up a lock on the house where I was living with my husband separately since after marriage because my in-laws were living in a rented house from almost 20 years as they basically belongs to Bihar. Matter was put up in front of police and now after 3 months an FIR has been launched against my in-laws under ipc section 406 and 34 but no action has been taken by police till now.I want to enter in the house because we were running a institute inside the house and my all belongings are locked inside the house but police is saying we can't help you regarding this. Now my question is if I break the lock and enters in the house, legal action could be taken against me by police? What other legal action I can take to take immediate entry in the house?

A. Under what provision under the law, did your in-laws had put the lock in your house. You being the widow wife is entitled to the property of your deceased husband. Under the Hindu Succession Act you are the rightful owner of the self earned property of your husband. Get legal heir certificate from the local municipality and get the property titled in your name.
