A. Dear Sir,
Nothing to worry because all laws are in favour of married woman. Ask your daughter to file DV case seeking following reliefs.
=====================================================================

PRAYER
HENCE THE APPLICANT HUMBLY PRAYS
1. to take cognizance for the offence punishable u/s 498A IPC and punish Respondent1 to 3 as per law and extend police protection to the deponent,
2. Pass orders u/s 19, based upon S.17, granting separate residence for herself and her three children at a monthly rent of Rs. 20,000/- and advance of Rs. 5,00,000/-.
3. Pass orders u/s 18, in totality against Respondent1 to 3,

5. Pass orders granting Rs. 5,00,000/- for setting up house hold requirements, in granted residence, to make it livable, as the applicant cannot return to the house of Respondent1 as he is residing in the house of respondent No. 3, which is legally prohibited,
6. Pass orders granting litigation expenses of Rs.1,00,000/- as the applicant made to wander from pillar to post for getting legal aid to attend the Hon’ble Court, whereas, the Respondent1 falsely filed Divorce Petition.
7. The applicant also filed interim application supported by affidavit u/s 23(1) and (2) of D.V.Act,

Now in lower court matter is running and Rs 6000 has been passed by lower court as interim maintenance which I am paying regularly. But due to stay on my mother, sister and brother, the cross questioning of my wife in lower court is not possible and the judge of lower court is telling to withdraw the case from high court. I don't no what to do. Please guide me what should I do. Should I withdraw my case from high court. If not to withdraw from high court then what will happen in lower court.

A. Keep pusuing your case in High court only.

My daughter filed a domestic violence case. The husband wants from wife's employer that how much time wife was logged in computer during her stay at home. Wife works in a private IT company. Will the court allow the plea of the respondents?

A. what it has to do with DV case? Obviously court is not going to allow such plea if its intention is to abuse the proceeding of the court.

With the rampant increase in false rape and domestic violence by women's against men in India.Are there some law's which may protect men protect men in case he is innocent.or he will be directly sentenced to custody,even if he is innocent.?

A. No one can stop a person to lodge a complaint under the provisions of the law against anybody. It's the constitutional right that has been conferred to every citizen of our country. However the real test of its genuinity can only be ascertained by the Court of law on the report of the investigating officer and evidences. These laws are not bias and in no way discriminating any particular gender. In fact there are many such incidents reported where helpless women victimised and needs to be protected against the atrocities of men. If a man is innocent, Court is there to protect his rights too. False case fall under the purview of section 182 of IPC.

Could you please provide alternative option to initiate hearing in court for scenario that " wife raise charges against her husband, father/mother/brother in law as domestic violence, charges for dowry etc. Main accused husband ran away and not willing to surrender. As a result, hearing for other accused's case not yet started and are suffering a lot, although they are not guilty/having sufficient proofs also. Please provide references of similar situation case filed in court.

A. Client may opt a move in court concerned for framing or trial in absconding of husband, or for criminal writ or quashing if in-laws has been falsely been involved.
