VERY GOOD AFTER NOON SIR , RESPECTED SIR 2 WEEKS AGO WE HAVE A GENERAL ARGUMENTS WITH ONE OF OUR RELATIVES ,BUT THEY ARE MAKING IT VERY BIG MATTER AND THEY HAVE PUT SOME VERY FALSE CASES ON MY FATHER , MOM AND SOME OTHER FAMILY MEMBERS .. THEY HAVE PUT ON US Dt-12/11/15,U/S - 324/323/506/34 AND Dt-12/11/15,U/S - 324/323/506/114 IPC ..THIS CASES ARE FALSE AND WE HAVE NOT EVEN TOUCH THEM IN THAT ARGUMENT . SIR PLEASE HELP ME IN REGARING THIS ...I M FROM KOLKATA ..

A. What are the status of cases as of now

A 14+ years old girl child has been mentally abused and neglected for last 4 years now and the child cannot tolerate as the situation exceeds the limit. She does not want to stay with her parents at all. What are the legal options in India available that the girl can approach for her own protection. If the girl wants to live with any other family who loves her lot and she also loves the family too much, is it possible that the family gets the custody of that child? As she is above 14, whether her desire can be addressed or not?

A. She must approach the district child welfare committee against all her parents. They will take care of her and also they will take action against the responsible persons

I have been in an live in relationship since 2015 and things were fine and I got pregnant for first time in the end of 2016 and we were financialy in a really bad place so after some fight a discussion I got abortion. Then some time later he asked me for 2lack loan for one week that I gave him, but he never paid back and in couple of months I got pregnant again and was hell bent on keeping it and ending it with him but he said if I do this he will commit suicide we fought fir days and as I had just got divorced i didn't wanted to be left by another one again as we were in a live in, I gave up and took the pill, I was broken for days, I told him I can't go on like this and I want to have my family to which he assure me that he needs some time as his father is very strict and he belongs to haryana and they don't let love marriage happen, but he said he will make everything fine, I gave him benefit of doubt, things seemed fine he is very loving and caring, near the time of Diwali last year he had to go home and when he goes home I usually stay with my family so I also packed and we went to my home he left for his home a day later, and he called as usual at first but then as time passed he started calling less and less, we got in a lot of fights as this never happened before, after 2 months he came back, we are still staying at my mother's as he has no money to pay the rent, I can't pay as I had given all the money I had to him already, I have nothing left and I already told him we should get smaller place so this time it's his responsiblty, I had already paid laks in rent before, he says he is trying to arrange money months pass still nothing we are at my mother's, I got pregnant again this time everyone knows, and before this we had decided to get married on his and my father's birthday, he agreed, we told everyone in our family, but month before his birthday his father had an accident and had to get hospitalised, so he said me being pregnant at this time will bring shame to his family, and I kind of knew this would happen and even my mother said that he is not wrong, he promised that he will talk to his family and will do what's best for us, he made me sure that we are getting married in March and all I had to do is to take the pill. I believed him as I wanted to get married soon, he left the next day, he called 3 days regularly and made sure I took all the pills and after that he just stopped calling and never came back I still have his clothes and documents, he didn't even paid the rent i had to sell my pc and camera to pay the rent and when I go to get my things to my shock my home has been robed, nothing other then clothes is left. I lost everything my baby, my respect,anything i managed to buy in past 2 years everything is gone. And he has such an ego he says he did all this as this is the best for us and he has no remorse. I need to know can I sue him to make me kill my unborn under false pretence, and to destroy my reputation.

A. U can file rape case against the boy friend for having physical relationship with you on pretext of marrige and also u can file compelling u to kill unborn child.Lodge FIR to police regarding your matters.It is my advise don't have physical relationship before marriage

I am 18 years old and a female. My father is extremely violent by nature, and threatens me with physical violence whenever I refuse to obey him, provided that I have my own perceptions which at times do not match with his own. He has caused me extreme emotional and physical suffering (included kicking, punching, strangling and pulling my hair). He has physically abused me many times in front of my siblings. Only yesterday night he threatened to kill me if I ever disagreed with him or came between his relationship with my mother. I have been accepting this abuse for a long time only because I felt that he was my legal guardian and corporal punishment is legal in India for parents, but now I'm an adult and refuse to accept such treatment. Please help me out.

As you are a major now, you can take decisions of your life on your own and move out of the house if you wish to. You can also take the help of the police in this regard and file a case of domestic violence against your abusive father. She lives in Hassan, I live in Bangalore but she filed Domestic violence is in Mysore. the only reason they are giving is register marriage is in mysore which happened in 2007. Can I file for Transfer petition in High court Bangalore to transfer it to Bangalore or Hassan, because Mysore does not have jurisdiction(section 27 of DV)?

A. Yes u can file a transfer petition.The domestic violence case should have filed where both of u last resided together or where she is currently resides or where u reside.

Dear sir/mam my sister got second marriage.she was divorced from her first marriage in the panchayat but not from court.second husband did the same means both husband and wife married this marriage without taking divorce from court. Now second husband is beating my sister for dowry.my question is that if my sister can complaint 498a against him.

Yes, she is recognized as wife as such though illegal she has status of wife and she can put all cases which are available to legal wife.

Sir my brother addicted to alcohol n my entire family is suffering by his torture....he harrases his wife n we are worried about his child ....my brother abuses evryone whoevr tries to control him ...mainly he tortures his wife and child...we complained about him in our near by ps but could not find a sulution....sir pleas advice us how to control him as per law .....his wife our sister in law sufferng a lot..

A. Before approaching for a legal action take alternative counseling & advisory by your designated CP they will also have dept. for Women & Child welfare , better to consult a Lawyer from Vidhikarya panel quickly.

I got married in april 2015. I had been mentally tortured by my inlaws for 2 years. In march 2017, my husband beated me and i got minor injuries as well. Then, i filed a domestic violence complaint against my husband and my inlaws. In that complaint, i mentioned that they asked me for the gifts by the name of rituals. However, at that time, we compromised and me and my husband along with our son started living separately from inlaws. Since then, whenever i talk to my husband regarding returning the gold jwellery and other electrobnic items which had been given to me by my parents on my marriage, either he starts fighting with me or stop talking to me. Now he is saying that he is insecure, that if he gives me all my dowry back, i may complain again for dowry not returned. What surety i can give him to take back all my dowry?

A. Dear Madam,

If you are residing separately then the question of returning dowry arises. Even otherwise you may acknowledge receipt of all the dowry amounts/articles by way of executing on Rs. 200 stamp paper with signatures of yourself, your parents and witnesses. This document is sufficient for him.

My father is retired now he always use to hit my mother, now we can't take it so we want to separate our mother, they are living in my brother's house and my father is not ready to leave the house, he has good pension, his only aim is to make my mother's life hell... Is there any way that we can make him leave this house. We don't want to go to court and fight for years as they both are all ready old, we want our mother to live tension free.

A. Dear Sir,
There is no issue you can take your mother with you and keep her safe in your house. If your father comes and claims then threaten him to lodge police complaint. If police calls your mother then you mother must say that she is not willing to reside with her husband.

I am a 22year old unmarried girl , I was in a relationship with a guy from past 3years and ds was my 2nd relationship. Previous I was loving a guy and due to alcohol effects I lost my virginity and we broke up with consent from both the end. Before getting into 2nd relationship I informed him everything and asked him to rethink his decision to love me. He said he too had a love before and he too non virgin guy he too had breakup and he know that pain. So I agreed hoping that he will not cheat. We were living like a husband and wife and 6months we lived in a living together relationship too. Later I asked him to marry me and he started giving reasons and now his parents blamed me for everything and they tuk him away from me. I'm damn addicted to him , I love him so much. He played in my life so I want him to marry me plz guide me how can I go legally to make him to marry me.

A. 1. You can not force him to marry you but you can indirectly you can give him pressure to marry you.

2. File a police complaint against him for the allegations of cheating / promising you to marry / Rape.
