If there is apprehension of arrest the proposed accused may immediately approached Sessions Court or High Court to get such bail. However registering of FIR is not mandatory.

Ideally you should file a complaint in this city only, as it will be helpful to the Police and courts to take action against them. If police doesn't listen to you then go to the higher authority and if also there is zero response then File a suit of mental harassment and physical violence(If it happened) against your husband. Also file a suit against the police officials for neglecting the case and ask the court to give the police protection.
