A. Hi
Presently BDS Courses are governed under Dental council of India and not under MCI .
Also BDS degree is NOT recognized as a Medical Course by MCI as of date.
So, technically, Food safety officer post should only be held by MBBS graduates who come under MCI.
You can file a writ and challenge the appointment of BDS graduates as a food safety officer.

A. An employer cannot dismiss a woman for taking maternity leave and cannot serve a termination notice to a woman on maternity leave which expires before the maternity leave ends. Also, an employer can’t change the terms of service to the woman’s disadvantage during her maternity leave.

Further, maternity benefit and the medical bonus will have to be paid to a woman who is discharged or dismissed during pregnancy unless it is for gross misconduct.

A. 1. Yes, we should send a legal notice, for due salary and reinstatement.
2. This falls under ID law and a separate court is there as per the state. ( mediation through labour inspector is mandatory to file this).
3. This require complete understanding of the issues, reading through your offer letter, state law etc.

4. Yes 100%, it is illegal

A. You can tell them to go with the decision they wanted to make but you don't resign. As you have good performance track record and didn't engaged in any breaches of employment agreement then nothing can be done in arbitrary manner.

If any such termination (rare) taken then you can definitely have merit in your case.
