Sir, i am working in a School operated by an samiti. They make a Karmchari Kalyan Kosh and add all the employees (approx 250) without our permission or any information. They are deducting rs. 300 per month from our salary for that. they said that we can take loan benefits and we will get bank interest on that amount. Karmchari Kalyan Kosh has members to operate it. but all the members of samiti was chosen by samiti. so they choose president and other member according them. They said that they are depositing our money in bank but they refused to give information about bank details. actually they are using our money and getting interest by market. If we refuse to deduct amount from salary they threat to terminate.so please help me what we can do about it. Thanks

A. dear client in your matter You have the right to get to know the amount that is being deducted from your salary and it can be only deducted after taking permission from you. Request you to kindly share across the appointment letter, pay slip etc for review.

I was working as a Assitant Professor in a Technical University. One fine day I got a termination mail mentioning 1 month notice period. When I asked the reason from top management, they said "Patron has decided" When I asked the patron he replied "Top management does not wants you" I told them that my student feedback is good, Patron replied "That does not matter" My termination mail was mailed to every employee of the institution. My 3 month salary was kept hold for 3 months. What can I do to have justise?

A. dear client Without wasting any time file a case against the management for reinstatement before competent Civil court of jurisdiction in your area.

Hi, I have been working with an employer for the past 4 months. The offer was shared with me for Internship of 2 months. In very first month after 2 weeks of training , I was virtually aligned with a project where my services was used as a full time employee. As per company's past trend and existing employees, employer confirms employee's employment with the company as a permanent employee and salary is given to the employee after job confirmation. I waited for 2 months since I was in hope that after two months I will get the offer letter for permanent employment. I kept on working with the project. As per my Project lead , my feedback is shared with the HR along with the requisition related approvals. After two months , when I reached out to HR department , I was told that it might take some time and I started waiting again. After 3 months , I reached out to the senior person of HR and the guy talked to us very rudely and tried de motivating me with very harsh words. As per him , he was denying giving employment or alternatively asked me to work for approx 3 more months that toi without getting paid. They have never confirmed me that my internship period is being extended. They are continuously giving promises and asking me to wait and wait. I am a good resource of the team and team doesn't want to loose me. Even after 4 months, they have no answer on when my salary will be started. There are many such Interns in the company from whom company is taking services and not paying for it. My concern here is - What are my rights working on the position of intern - Can they make me work like a full time resource as I have been doing for the last 4 months without getting paid. - Can I get a compensation for my services - Can I file a complaint against the employer and how it can be harmful for my career. Thanks

A. dear client in your case You have the basic right while working as an intern.See genealogy internship is pursued to make the interns learn things. The period of internship in terms of hours required is dependent on the intern and the person who has given you the opportunity to intern. The compensation can be given and is totally dependent on the person giving you the internship opportunity. You cannot file a complaint. You may leave the services if you want.

My employer (pvt LTD company) told me to stay at home untill matter resolved. And took my office access card and laptop and also disabled my office email Id. Few days ago I had escalated about company's CEO and HR to company's ethics committee. About how hr and CEO were mentally harrasing me to quit the job as the role is not as per discussed or designation mentioned in the appointment letter.

A. dear client your matter is not clear one. because After clearly understanding the entire matter, then a proper professional advice can be given to you.

Dear sir, I have resigned a 20 days back - actually my probation is completed and notice period should be 60 days , company is asking me to leave in 30 days or with immediate effect and they will pay only for 20 days upto today like that , please check the below clause in offer letter and tell me - as per my knowledge they should pay my 60 days Gross salary I feel. Please let me know whether they are correct or I am correct. . Post confirmation, your services may be terminated by either party by giving 60 days notice period in writing or 2 months gross CTC in lieu of notice. However the Company reserves the right not to accept payment in lieu of notice and at its sole discretion enforce the notice period. 2. Actual probation is 6 months, but they have not informed me whether they confirmed or extende like that ... after my resignation only I came to know that Manager kept it on hold no am arguing that it is their mistake being kept it on hold either accept confirmation/ reject confirmation sir, so I am telling them that they should give 60 days. please tell me is that Legal what they are doing.. You will be on probation for a period of six months, which may be extended by the Company at its discretion. At the end of the probation period, your services with the Company would be confirmed subject to your performance meeting the requisite standards. During the probation period, Thanks, Narayan

A. dear client in your case You have to consult senior lawyer to help you obtain the benefits.

My mother is a teacher in a renowned private school in Mumbai. She is retiring this year after 17years of service. According to the school authorities, they will decide the amount she should get as gratuity. Is this true? Is there a new law regarding this? Isn't it calculated in a certain way anymore? Please help. We are worried

A. dear client in your case The amount of gratuity is to be decided as per the provisions of the Indian Gratuity Act, 1972.

Hi Sir/Madam, My wife has recently joined a school as a teacher but after working for 2 days she didn't like the job profile and work environment and decided to quit the job with immediate effect without serving the notice. Now the owner of the school is threatening to take legal action against her for not serving the notice. My wife has not signed any bond but yes she has got the Service agreement for the job which she has signed which states that the training expenses will be incurred if any person leaves the job without notice however she has not got any training from the school. Please advise whether the school authority can take any legal action or not? Thanks in advance.

A. dear client If the agreement says that a new joinee has to pay then you have to. Please share the copy of agreement for review and then will be able to advice properly.
