A. Dear Sir, Always the Inspectors will be in favour of employers. More so Courts are reluctant to award compensation due to afraid more and more cases being filed by similar candidates. Please call me and take legal consultancy on my mobile through the administrators of this website.

I was promoted to Ad-hoc AAO by passing the departmental exam. Head Quarter issued a circular on 02.07.18 by which eligible candidate may appear in SAS Civil Audit exam. I sought clarification from Local Admin (my office) regarding my eligibility but I was not answered that time. Later regular promotion order was issued in favour of me on 10.08.19 and Local Admin. issued a circular on 29.08.18 inviting me to fill up the form for the said exam. Hence I refused to accept the promotion on 29.08.18 as after getting regular promotion candidate was not eligible to appear in the said exam. Later Head Quarter denied me to appear in the exam giving reference to its earlier circular dated 02.07.18. In this situation I was debarred for getting promotion for 1 year and could not also appear in the exam. Had I not been allowed to fill up the form, I would not refuse to accept the promotion. I think department is at fault who invited me without consulting the Head Quarter and I sought clarification also from my office. Pl guide me whether I should knock the door of court to get the promotion from the back date

Hello, I had joined a company to help them build a new division on a consulting agreement 7 months back. The agreement is for 3 years. The business did not pick up as expected and there is a huge pressure from the investor for returns, as he is only looking at monthly returns and not ready to wait for the business to pick up. As per the agreement, if I quit in the middle, I have to pay back all the amount he has invested till date. The current investment has been utilized towards salaries and office expenses. The total amount invested till date would be around 20L I would like to quit and would like to understand if there is any way that I can fight against the amount to be repaid. If nothing works, I am willing to pay the amount paid towards my salary back. We have put in efforts but the business has not picked up as expected. Please suggest a way out.

I joined a company(national brand) on 21st feb 2019 at the time of joining they took 2 cheque of 1 lakh each.i got 15 days training.just after training I was posted to Chennai branch.within 2 week I realised that I can not work in this company.because of language barrier I am not able to connect with people...in office my boss used to talk in local language and I felt ignored.in office mobile phone was not allowed...you can not go outside without permission...it felt like I am in jail.i discussed with my seniors and told them to transfer me to any branch in North india but they tried to convince me.i sent multiple emails to hr but there was no response.i was working under mental stress.my health started deteriorating.at one point of time it became impossible for me to continue so I left it and told them that my health condition is not good. Now after 15 days I got an email and a letter by post from the company saying that you are absent from the work without information , report at branch within 3 days otherwise legal action will be taken against you.also they are saying that due to your absence company is suffering hugely but it is not at all true.

A. Nothing more than the cost of training and one months salary can be deducted. for non service of notice period. Thanks.

I was selected as a JAO (Junior Accounts Officer) in one government sector company. While giving job notification by company, it was clearly mentioned that bond is applicable from the date of JAO appointment and appointment will be done only after passing the exam which is conducted by them after completion of 11 weeks training. But, whereas in signed agreement between me and company before commencement of training stating that bond is applicable from the first date of training, which is against to job notification released by the same company. Currently, I am in training stage at 6 week out of total 11 weeks and wanted to quit from the job because of personal reasons. In this situation, when agreement and job notifications are contradict to each other, which one will prevail. Am i liable to pay bond amount as per agreement or any chances to quit without paying bond amount based on job notification. Please suggest me in this matter.

HI Sir, I recently resigned from a company as i got an offer from another one where i was suppose to join on 11 March. On my first day in the new company i was told that my education document are yet to be verified and hence my joining will be deferred by 1 week. They kept saying this for few weeks and after some time told me that one of my previous employer has given a negative feedback and hence they cannot hire me. i have a clean exit from all my employers and this new company is not ready to give it to me in writing. As per their offer letter the background check was to happen in 3 weeks and they took 3 months for that, had i been informed earlier i would still have my old job. Today i am jobless, they are not giving me anything in writing and when i asked for compensation because of the delay from their end they have sent me with a cease and decisit notice. Please advise.
