I work in a private company and due to the current pandemic situation I have been doing work from home. My working hour is 8 hours a day but recently my employer is demanding me to work 2 more extra hours daily. They want me to work for 10 hours a day from now on. So, my question is: Can I be forced to work overtime? or Do we have a choice to deny their demand? I'm also afraid that if I deny their demand, I might lose my job.

It is not your individual problem but a problem being faced by majority of your people. After MNCs entered into to India the young people lost their voice, no labor unions, no voice raising, over night terminations, no labor law apply. I am a permanent employee and working with a multinational company my manager and HR both are harrasing me a lot and now forcing me for resignation otherwise they will terminate me as they are senior also no one is listening me.

A. You can tell them to go with the decision they wanted to make but you don't resign. As you have good performance track record and didn't engaged in any breaches of employment agreement then nothing can be done in arbitrary manner.

If any such termination (rare) taken then you can definitely have merit in your case.

I'm an employee of IT company, I'm working in this company for last 4 years. Yesterday I along with many of my colleagues received a HR mail stating we all will not get paid from April 17th 2020 till further notice. Previously on 4th April we already had a mail from CEO that salary cuts will implement from coming moths salary, but yesterday the force LWP mail imposed on us. I want to know the legal options we had against this because as per the MHA order released on 29th March no employer can terminate or cut wages from employees during the lock-down period.

I hope you are doing good. In ordinary scenarios, the company has the right to LWP or lay off by following the rules and regulations.

But at the present situation is different than the ordinary, unprecedented and rare unforecastable, as per the directive of the govt. the employers to close/shut their organization and no question of the movement of employees. I am indian and i have done regular M.tech which is 2 years course and in 2nd year there was project or internship period so i joined the company .Now i have applied for govt job on the basis of that 1 year experience. Can i show my Mtech as well? As period of both will overlap. Is there any problem to add Mtech degree in service book?

I retired from bihar government service in year 2013. My pension and other due arrears are still not cleared despite multiple communications. My provisional pension stopped in October 2015 without any official communication citing the reason. I am thinking of initiating legal action. Please provide guidance.

Sir, My father has BC (backward Class) certificate issued by Punjab .he used to live in Ferozpur Distt..But then in 1985 He Got Posted in Chandigarh In punjab Govt as employee... Now My entire family is living here in chandigarh since 1985... we the kids have got OBC certificate issued By SDM chandigarh ...My caste comes Both In central As well as Punjab State list............ Now I want to apply for a job At punjab public service commision.. under Punjab BC (punjab) Category........here They ask for domicile Certificate of punjab too......I want to know can I avail The reservation in punjab govt?.....My father is still in service with punjab govt at chandigarh.....I just have adhaar and pan card as residence proof......No one in the family has domicile certificate of Chandigarh......

Please visit DC/ SDM office chandigarh as already they have issued OBC certificate and submit the ID and address proof and Xerox copy of OBC certificate along with the application ( kindly mention the purpose of the certificate as Job). Hi Sir, I used to work in MNC in mumbai and later I got selected as a clerk in government department in rajasthan and i was asked to fill up the evidentiary letter before joining the job. In the evidentiary letter there was a column stating that ‘enter the name of the places where you have stayed for more than one year in the past 5 years’. I mentioned NIL over there though i resided in mumbai at one place for around 11-12 months but i was not sure whether i completed residing over there for more than one year. I later got selected in another government job after 2 years on a higher post where i was asked to fill the evidentiary letter and in that letter there was again the same column stating ‘ enter the name of the places where you have stayed for more than one year in the past 5 years’. This time i confirmed from my landlord lord about my stay over there in mumbai and they confirmed that i had stayed for one year in the past so this time i mentioned the address in the evidentiary letter where i had stayed for more than one year in the past 5 years. I have joined that new job now. Will there any issue in my new job in future becoz in my previous job i didnt mention that i stayed in mumbai for more than one year and in the new job i mentioned the same. My police verification is yet pending. Although no FIR/case was filed against me during my tenure of stay in mumbai.

I want to leave my company my agreement ends next month. Can my company take legal action if I give notice at this time (20 day before the agreement ends). Can they sue me if I give notice during agreement period because I am still at agreement term and they have right to terminate an employee if the employee is in agreement term and recover the amount prescribed in agreement as per our agreement form. What can I do if they misuse my agreement?

A. Only the amount spent on you for training purposes is recoverable.
It would be wise if you leave after the said period.
