Hello, I'm working in Konkan Railway Corporation Ltd. (a Railway PSU) as Trainee Jr.Engineer for last 8 months and I've resigned from KRCL as I'm selected for a better job in Gujarat state govt., for which I had applied well in advance of joining KRCL & even the main exam for it was conducted before joining at KRCL. But at the time of joining KRCL we had signed a service agreement and an indemnity bond on a Rs.100 non-judicial stamp paper as per the requirements of the Offer of appointment, according to which we shall either have to serve KRCL for 5yrs after completion of 1yr training or to refund the entire training cost, all pay and allowances received as stipend and 12.5% interest there on. All these adds to a huge amount, so I requested them in writing to transfer this bond to my next job as it is a Govt. job, in accordance with the guidelines of the Dept. of Public Enterprises i.e. DPE O.M. No. 15(2)/2003-DPE(GM)/GL-57 dated 29th July, 2004, but they are denying it, saying that it is not applicable to KRCL as we have not mentioned any specific amount on your indemnity bond and it is not Notarized, it is just an agreement given by you to repay all the cost to company. I asked them to give that in writing and with the copy of any reference, on the basis of wich they are denying it, but they are not cooperating and asking me to pay all the money to get the relieving. I've to join the next job within a month, where I've already asked for an extension citing the reason of properly getting relieved from KRCL. They are threatening me that if I keep on bothering them for transfer of bond then it will delay the relieving and will be of no use for me. Also note that as per DPE guideline on the basis of which I'm seeking transfer of bond requires that the application must have been forwarded through the proper channel but same was not possible in my case as I had applied for the job in Gujarat almost 9 months before joining KRCL. Now what should I do in this case, should I pay the money, join the next job and later on take some action or do something right now and what can I do in both the case?

I am software engineer. I filed a complaint against my lead and Manager because of them i lost my peace of mind(having lack of sleep, mental stress, back pain etc.) because of that i am away from my work almost 4 months that is till date. I filed a case against them in my company with proofs but company has rejected by saying "The panel has reported that allegation made by you is unjustified and hence we are dismissing your complaint." I have shared all the proofs against them to HR's but they don't want to take any action against my manager. Company is forcing me to back to work in the same team where i was harassed. Please suggest me what to do next. I am ready to take legal action against them.

I leave a Pvt Ltd Company one year before but till date company has not pay my Balance salary due at the time of leave the company after notice of 23 days . I start my job there on trust without formal document as offer letter and Appointment letter because of nearest relation with company management person . Even they paid part salary in some month so balance is left at the time of leave the job which is due till date AND now not reply anything by company.

A. You should follow the following steps 1. Send a legal notice to the company [with a stipulated time period to revert back or comply with] If they fail to comply with such legal notice, then, 2. You can a civil suit for recovery of arrears of your salary.

My husband passed away during the settelment of his pf pension which is still pending. Now the employer approved the form with the pf account no and EPFO is denying that the pf account was closed in 2007 and shifted to different account. How do I know the whole story and circumstances under which my husband's account got closed and transferred and all the transactions and shares done by the employer?

I leave company after joining 4 days then got call from HR .I talk with my problem and said I will not come.but still they credited 2 month of salary in my account.I drop them mail saying that amount is crediting to my account.Now they are given me the threat of legal action if I don't give money back (amount is less than 1 lac) .I have all mail stated that I communicated to the company + informing about money credited .what should I do

A. Dear Sir, It is a civil action and dispute. Ask them to approach the Civil Court. Sir the HR called me and he said I will send legal notice or else come to duty. But now I am not able to go. I had paid a caution deposit of rupees 7500. Now he is again saying that pay 15000 but I don't have money.So, please help me to come out from this problem.

Dear Sir, I am working as a Assistant Manager in MAS Akshaya Sportswear (Special Economic Zone Unit), its Srilankan Based company, my total experience in this company is 6 years, Now company want close as per their internal issues, Now they are telling that they will give operators 3 month salaries as per the law, but not give it to executive and above level, they are telling this is the law, you people are not come under Industrial act 1947 company was register under the industrial act 1947, when the 500 operators & team leaders are getting the 3 months notice period salary, why the 20 executive and above people are not get. please give you suggestions and how to approach legally.

A. They are also bound to pay the such benefit to others as well you, subject to the agreement clauses in the appointment letter of you and others between the Company authorities.

Sir, Recently I have resigned my job without serving the notice period. Because there were no appraisal in the past financial year. Also many of the employees has resigned the job. Even there is a question on the notice periods salary.So i haven't served the notice period.Company has issued me the laptop as a asset, which due to some software issue I have given to my It dept,but they are saying that we haven't received it(in short they ate lying).For not serving notice period and Laptop handing over issue.They are demanding Rs 50,000 from me for that.Need Experts advice on this

Hi, I received an offer from company where they asked me to submit copies of original documents, but when I joined them, the HR informed me to submit an original marksheet & said they will keep it safe in bank locker as collateral. I needed the jon for survival & had no options other then accepting since I was unemployed. They gave me an undertaking of original marksheet (10th) on the company's letter head. I was employed there for approx a month while I got an offer in my hometown so i had to go back to my hometown. I submitted them a coloured laminated photocopy of 12th marksheet to get my 10th original marksheet. This happened under a camera. Due to this the owner of the company is also allegating that I have stolen their business data & clients information which is absolutely false. As per Labour law, no company can withhold an original certificate of an employee. i wanted to understand if the company owner can sue me under the court of law. They are also commencing their commercial business in basement of resedential property which is against the laws of municipal corporation of delhi. Please suggest If I can go against them because they informed me about this at the end moment where I was pressurised to submit the original certificate. (Not mentioned in the offer letter as well that I have to submit original certificate)
