A. Dear Client,
Your father have equal share over the property as your uncle. All 3 sons and 4 brothers have equal rights over the said ancestral property. Get a legal heir certificate from your councillor or chairman of your area. Then get a legal heir certificate from court in affidavit format.
One person can not claim the whole property without out other person’s consent. It will be illegal to do so.

Firstly explain the scenario to your husband. If required keep recordings of such actions. Speak to other family members, who can really help you. If all these doesn't work you have to lodge a complain under Section 498a, an FIR against your MIL,this might ruin your relationship with your husband. You have to be mentally prepared before taking such steps.
I would suggest you to first amicably settle the matter, then go for any such legal remedies.

Provision for Fighting One's Own Case as per Advocate's Act. Section 32 of the Advocate's Act clearly mentions, the court may allow any person to appear before it even if he is not an advocate. Therefore, one gets the statutory right to defend one's own case through Advocate Act in India.
