Me and my wife love each other very much. She doesn't like my mother. My father is doing domestic violence since childhood. So my mother is not willing to stay with my father and in current situation she stays with sister. I feel my responsibility towards her maintenance. Whenever me and my wife have disagreement on some family matter, she threatens to leave the house and has done many times so.My wife also sends msgs to my mother that she will put my mother and sister behind the bar. Eventually my wife's parent also threaten me the same. what should i do?

A. You can either compromise with your wife and make her happy so that she does not lodge any complaint for domestic violence and 498A complaint or else lodge a complaint with the local police station of such criminal intimidation by her and your in-laws to implicate you in a false complaint of domestic violence and 498A complaints. Thereafter you can either go for judicial separation or divorce of the ground of cruelty as she does not intend to live with your elderly mother.

Good day, I am staying in the same building as my in laws, but in a different flat. My in laws stay with their son and daughter in law. I have been noticing since quite some time that my parents in law are being tortured by their daughter in law which includes threats of suicide & filing case of dowry and attempt of rape against the father in law. Yesterday the daughter in law created scene by making cuts on her forearm with a knife. And this isn't the first time she did that. I didn't want to get involved, but I am now because now she has started threatening my wife (her sister in law). I am afraid it won't be late untill I will also be accused. I need legal advice on how to safeguard my family & myself & parents in law..

A. First, lodge a complaint with the local police against her for criminal intimidation u/s 506 IPC (that this girl is having suicidal tendencies and you should not be held responsible in case such a thing happens and further she threatens to file false case for dowry demand etc against her in-laws). If the local police do not take your complaint as FIR, write to the SP/CP and thereafter file an application u/s 156(3) CrPC before the Magistrate and get appropriate order for registering your complaint as FIR and to conduct an investigation. This criminal case against her will definitely save you and others affected persons. This complaint should be filed jointly by all the affected persons. Secondly after filing this criminal case, her husband should file a divorce petition on the ground of cruelty for constant threats to commit suicide, abusing her in-laws, defaming and maligning their reputation. I got married to a guy who is working in dubai native of andhra pradesh,india..after marriage i stayed with him till 3 months..once i concieved got back to my parents..from day 1 after marriage in -laws are harrasing alot for more dowry and abusing a lot..they thretened my husband not to talk to me and my parents..i gave birth to a baby girl.. many issues happened meanwhile..some of our relatives involved to resolve this..but of no use..they are abusing all of us and threatning to do whatever we want..it's been 2years of my marriage..from 2 months my husband is not attending our calls and not responding.. please advice me what to do and to proceed..we contacted police in our locality. .but of no use as they are saying that he is NRI we can't do anything.How to get him in contact to solve this..whether he want lo live with me or not..how long i have to wait with a child without contact with him.. please help me out of this .. awaiting your reply.. thank you

A. If police is not taking up your complaint, you can lodge your complaint with SP/CP and thereafter file an application u/s156(3) CrPC for dowry demand and domestic violence against your in-laws and your husband. Seek interim maintenance for yourself and your child through court.

My marriage was on first week of Feb 2018 She left me in first week of march without registration of marriage Last week of April we signed divorce agreement on 100 Rs stamp paper I found information that thus agreement is not valid. Now she marry to other person. Can I file bigamy against her? If yes then How can I prove my marriage without registration certificate of my marriage I have her second marriage certificate copy. My marriage was arranged marriage.

A. Assuming you to be a Hindu: If marriage is solemnised as per hindu customs & rituals it is valid marriage. The fact that it has not been registered does not affect the validity of the marriage. Without decree of divorce from a competent court of India neither of you can remarry. Documents required: Marriage Pictures/video, statement by way of affidavit of pandit who recited the rituals of the marriage, statement by way of affidavit of any two witnesses (guests) who had attended your marriage. Copy of the divorce agreement which itself is a vital evidence that marriage was solemnized between the parties. Lodge FIR against her u/s 494 IPC and her second husband u/s 498 IPC.

Hi, Hon'ble court ordered for visitation for 1st and 3rd Saturday and 1 hr each day a month. But wife is regularly bringing the children late by 20-25 minutes and leaving early i.e. getting total time is approx. 30-40 minutes only. We filed two complaints for the same and also that she is not bringing the children in children room and sit outside the children room, surrounding the children with herself and her counsel and associates, they need to reply the same on next date. But after that also, on this Saturday she again brought the children late and left early. Can we file contempt of court.

Dear Sir/Mam, I am in litigations with wife. My wife filed Divorce with u/s 24 and 26, Maintenance, Civil (earned in matrimonial time), 498a. In Divorce u/s 24 and 26, hon'ble court had decided interim of Rs. 4000/- per month for my two children out of my salary of 8000/- per month and maintenance to wife denied, whereas wife herself stated in court that her salary is Rs. 54,000 per month whereas her actual gross salary is around 70,000/= per month and her statement of her salary is on record in hon'ble court. 1. Is it mandatory to open her gross salary in the court? 2. If her actual net salary is in between 55-59k then is there u/s 340 attracted. 3. Is there any law in which i am eligible for maintenance and ailmoney from my wife (for equal status) as there is lot of difference in the salary and out of which i need to pay to the children along with the arrears of Rs. 80000/- approx. Please send me the link for the same and judgement if possible. 4. I am filing the review against the order, can i have some suggestions or advice for the same. Can it be possible to waive off the arrear amount.

Sir, as I posted my family matter that my mother has died 18 year ago , my father has done second marriage, I have one brother means we are two boys from my mother and step mother has two children i.e.,one 8 years girl and one 2 year boy, means we are total 4 children of my father, my father is earn property by government service. I.e., primary teacher, me and my brother upto 21 to 22 years old , I am big one i.e. 22 years old , our all education upto graduation is done by my mother's father ( grandfather) ,even we have lived in grandfather house from death of my mother.If me and my brother claim for property to father then how will be shares in property, is property will equally divide among three brothers or not? please advice me!

A. Only after the demise of your father you along with the other legal Class 1 heirs are entitled to share properties. However if your father makes a will before his death and makes his second wife and children the beneficiaries then you and your brother will loose your right to claim your share in the your father's self acquired property.

I am a 21 year old girl, living with my parents. They have been constantly forcing and pressurising me to get married. They even got me forcefully engaged once but I managed to get out of it. They wouldn't let me work or complete my education. I want to move out of the house and live independently. I need legal advice as to how I should go about it so that my family cannot stop me from leaving. I do not want to file a case as such. Just a legal document or something that would refrain them from contacting me or doing anything to me after I move out would be okay. Dear sir/ madam, I am Rakesh Kumar , I had married with Priyanka Kumari and it around five year. My wife attached with bharam kumari asharam. Know she do not want to live with me . She learn the God shive is his husband not me. She was force my the she need devorce other wise she will sucide. And asharam is really doing lot of help to my wife and one day my wife left the home. But know she living with he's mother and father but again telling that she need divorce and she live like Bharat kumari. Sir I know that I am not able to live without her because I know that she is doing wrong and she has symptoms of early sygopheana. So shall I do any thing to save her in am in Jaipur but presently she is in Bihar.

A. Don't make your life complicated. Let her live her life as Bharat Kumari. Go mutual consent divorce and get married with someone who knows your worth.
