My husband wants to get a marriage certificate after 7 years of marriage because he wants to go to abroad for work. But I don't want to get a marriage certificate done now as I want to divorce him. What option does he have now to get a proof of marriage so that he can go to abroad without me helping him?

My wife filed 498a case on me and my mother in Dec 2016 and DV case on me Dec 2017. DV case was disposed (June 2018) due to compromise. In Jan 2019, me and my wife filed a mutual consent divorce petition with zero terms and conditions (no maintenance / alimony / settlement), except one condition that both of us will withdraw cases against each other and shall not have any claims against each other in future. Both of us have given affidavits in the court stating the same. Then on 5th Dec 2019, the court granted the divorce decree. Now, my wife is not willing to withdraw or sign a no-objection to close the 498a case. Moreover, she changed her residence (address changed) after getting the mutual divorce and her whereabouts are absolutely not known. So I want to move the high court for quashing the 498a on merits that the complaint has been filed only with a view to cause harassment to me and my mother. My wife was never subjected to any cruelty, I have proofs for the same and on the contrary, I was subjected to cruelty at the hands of my wife. How to locate my wife's address legally for serving notices (because her whereabouts are not known)? And how long it may take in my case for the high court to consider quashing the case (498a)?

A. Dear Sir,
If it is a civil case you can release newspaper publication with the permission of Court. The High Court has no time limit to dispose of petition before it.

Hi There, I need a suggestion and help in my case. Long back in 2006 I left India and a case was registered again me and my family. After a long battle case was in our favor but I didn't come because of fear. Now I'm doing well and wants to come to India to set-up my business here. I need the OCI and for that I have sent the expired Indian passport to embassy. Later it was told that my passport was impounded by Gurgaon police. Now I'm not sure how could I proceed in this case. Case is already closed but I was not there and that girl took the divorce and got married. Questions: 1. How could I proceed this issue ? 2. How could I get the clearance from the local police (Gurgaon) so that I could get the OCI ? Please suggest. Regards, Manu

A. Hello Client,

If you are sure about the case status which was passed in your favour then apply for a certified copy of the judgement of the case by which you can prove that you are no longer an accused. take Advocate's help regarding this.

and if possible then communicate with the Police to find out the proper reason for impounding.

My wife has 2 sisters all are married. Her 2nd sister has expired due to kidney failure, now her sister husband want to marry again but he has a daughter studying 10+1. Now, he is asking the share in the properties of my wife's father. Is he eligible to get properties equally along with my wife and her another sister legally.

Im from SC they from OPEN. her fathe take her mobile,and documents and lock her in room for 7, 10 days. later on she told me that she tried to comited suiside on road and also she will come on 14/02/2020 or 30/03/2020 againt her family to marry me. ..... she is ready to give speach againt to police that she not being forced by boy (me) to marry. what should i do and should be my future step to prevent us. ...she is being torqure for get marry in her relatives so she is very feared and ready to escape even without document. my family ready to accept her. she taken 181 and 1091 number as if family her make more burden. as for my side i told her to 1st take written proof from police that she left her home with her choice and only then i will allow her.......what should our next step that will make my family safe if they file compalin agints us for kidnaping girl...also if she left without document how we can get back it from her family by legal way.

i m biological father of child aged 21 year which i have given to my real elder brother now last 7 years they have completely changed and ignoring me and very rude to me also not serious for child and inclined more affection to their daughter . i want to take return of my child.

A. Dear Sir/Madam,
If your son was not legally given in adoption then nobody restrain you from taking your son back to your custody. However now the child is aged 21 years as such it can take its own decision and nobody can prevent it.

Dear sir my cousin(sister)'s father died when she was 10 years old(now she is 19).her mother married another person .a baby boy was born(current age is 12 years).her mother had a land property whose value is 40 lakhs (now) registered in her mother name. But recently 20 days back her mother also died.my cousin's step father wants to marry another lady by neglecting my cousin . question is.......can my cousin get any amount if that property is sold for 40 lakhs. if she can get, how much she can get ? can her step father sell the property without signature of my cousin ?. how to proceed legally to get the 40 lakhs(if the property is sold) ? and how much can she get?

Ask your cousin to immediately file a suit to get her property or amount which belongs to her mother.
