A. Dear Client,

You are entitled to receive maintenance from your father as per Section 125 of the Criminal Procedure Code, specifically under clause 1(c) of the Section. It provides that a person must maintain "his legitimate or illegitimate child (not being a married daughter) who has attained majority, where such child is, by reason of any physical or mental abnormality or injury unable to maintain itself". Therefore you can file a petition under this section.

Thank you

icon Can a child make a stand for emotional and developmental damage ?

Can a child get a sum and cut off with parents. Would it be possible to do it in court in this country ? Can emotional and developmental damage, strain or trauma, irresponsibility ,mental consequences

A. Dear Client
If you're a minor and the parents are incompetent you'll be under the guardianship of court. However, if this isn't the case you can file a case in the court seeking for separation and then demand for the damages caused. Moreover, if you are a girl, then you can file a case under the Domestic Violence Act.
Thanks

If the property is bought in the joint name of the spouses then she will have equal rights in the property as you have. Even if you have paid all the money but since she is made as an owner in the property (if registration is over) then she will be having all rights like you.

A. Dear Sir,
Ask your uncle and aunty to adopt you officially and thus you will become adopted son of them or ask them to file a suit for declaration claiming yourself as foster son of your uncle and aunty. Or you may file a suit for permanent injunction claiming severance from your natural parents and they will not be allowed to interfere into your private life in future.

A. Dear Client,
There can be no action for breach of promise unless a contract to marry has been made. There are no formal requirements regarding the contract. It need not to be evidenced by writing and the law prescribes no particular form of words. A promise by one person to marry another is not binding unless and until that other also promises to marry the first person. Mutual promises to marry may be implied from the conduct of the parties. A declaration of intention to marry another made to a ...ReadMore

A. Dear Sir,
Yes, you can file it as you have to maintain status equivalent to that of your husband as such yourself and your child get sufficient maintenance. Better file maintenance under Section 125 of Cr.P.C and seek interim maintenance which will be allowed on the date of filing itself.
