A. Dear Client,
Non-compliance of a mere portion of the required notice period cannot disentitle an employee from the entire F & F Settlement dues receivable to him on resignation. So, withholding or refusing to disburse the F & F Settlement of dues to an outgoing employee amounts to unfair labour practice on the part of the Employer. In the given scenario, you just serve a legal notice to your Company demanding the issue of a relieving letter and for disbursement of F & F settlement dues receivabl ...ReadMore

A. Dear Client,
Both the employee and employer are required to contribute a fixed percentage of the employee’s salary to the EPF account. The current contribution rate is 12% of the employee’s basic salary plus dearness allowance (DA). EPF contribution is mandatory for employees with a basic salary plus DA of up to ₹15,000 per month. For employees earning above this threshold limit, it is optional, subject to approval from the Assistant PF Commissioner. If the employee’s basic salary and ...ReadMore

A. Dear Client,
If there is any registered Society or Association of the buildings, then you can bring the matter to their notice for a resolution in the matter. Otherwise, in a standalone building, the flat owner does not need the consent of a neighbor owner to use its own share of the building. You can raise your concern before the local administration including the health deptt. for a resolution in the matter.

A. Dear Client,
In the absence of an Agreement to sell, you transferred the value of the property to the Seller typically makes your case a little bit weak in establishing your claim for specific performance before the Court. However, based on the document of the transaction of money between you and the seller and the evidence of eyewitnesses, serving a legal notice, you can file a civil suit for specific performance against the seller seeking an order for registration of the said property in your ...ReadMore

A. Dear Client,
The Parking area (Stilt, Open or whatever) is not covered under Floor Space Index (FSI) and hence is not saleable. Buyers must check the Builder-Buyer agreement specifically to see if they are paying for their parking slot. As per Section 2 (n) of the RERA Act, common areas include open parking spaces, and thus, open car parking spaces cannot be sold. The Supreme Court of India ruled in 2010 that developers cannot sell stilt or open parking spaces as individual units.

A. Dear client, you can file an insolvency petition under Provincial Insolvency Act, 1920 if the amount of debt must be more than Rs. 500. If you have declared as insolvent there will be a negative effect on your future prospects. Though you can get a job but it will be more difficult as being an insolvent. And no lender will give you any money afterwards.

A. Dear client, first contact the employer and ask for the full and final settlement. If theres is no progress or action taken then send a legal notice to the employer for full and final settlement. Even then then is no reply or action then you can file a complaint in the labour court on the employer.

A. Dear Client,

Based on the limited facts you have stated, Take an assumption regarding the calculation of income tax in a financial year of your transaction where the amount is X from which 98% of X goes to the company and 2% Of X goes to you. if that 2% of the X is more than Rs.2.5 Lakhs then income tax needs to be paid to the Government.
