I am a landlord of a property let out for about 25 years covered under the rent control act rajasthan. Can we file a petition directly under bonafide necessity or a notice is required first. We do not have a house and stay on rent.

Landlord made false agreement with my false signature ,court gave permission for verification of sign ,against this permission ,he got stay from high court. Do district court can give judgement without removal of stay order

A. dear client in your matter District court cannot pass judgement against the order of HC. You have to first seek objection on the stay of HC, file the same before the District Court and then the DC will pass an order.

How much average time is taken to decide a case in high court

A. dear client in your matter It depends upon case to case high court to court and j even udge to judge to judge also.However in case of a urgent and genuine case, u can file an application for early hearing if there is no date of hearing and if it is rejected then move supreme court for a direction to high court for early disposal of the case.

How much time is taken to remove the stay order in the high court

A. dear client in your case Any stay from court of justice can be removed any time.You fails to mention stay whether it criminal or civil and permanent/ temporary.

Landlord make a false agreement with my sign I got permission for verification of sign from the court If the report comes not in my favor Can I get the chance to oppose the report

A. dear client in your matter In the present situation you need to get his stay quashed from the High court only. District court has no power to override the order of the High Court because of hierarchy.

Landlord make a rent agreement on rs 100 stamp paper the rent was 6600 per month it is legal

Mr Sukhani and his family started living in our house from 1962-63 on verbal agreement with my grandfather. Every month they pay us a meagre amount of rent with full facility and use the property on their will. They do not seek any kind of permission for anything like repair or whitewash or wiring or anything related to maintainance of their flat. Now Mr Sukhani expired in 2017 but his wife and children and grandchildren still refuses to leave the apartment. Kindly suggest whether the occupancy is legal or illegal and advice the necessary course of action at the earliest.
