Dear Sir, My grandfather died in 1995,he had made a property (house) in 1966,my father have three brothers and two sisters at the time of death no will was found but we all now that there must be a will but nobody knows where is the will,When in 2013 my father and (one of his brother and his two sisters together) filed a property distribution case in civil court.One of my uncle(the eldest brother),who was not with my father during filing of property distribution case respond in the court that he had a will in which my grandfather given all the property to him because he helped financialy my grandfather in his life time. My father and his one brother and two sisters respond in the court that "when he will submitted the will we will challenged it", but till 2018 he(my uncle) did not submitted (file)the will in the court, now in 2018,my father(his one brother and two sister) filed an affidavit that the will is forged. Last week on 25-10-2018,my uncle filed a probate case with original will having signatures of my grandfather and signatures of two witness with afadavit of one witness. None of us (all the brother and sisters) know the witness. As per the will all the movable and immovable property are in my uncle name and signatures of my grandfather seems to be genuine and one of the witness also confirm it in afadavit. Please advise us what should we do... 1)Our advocate advise us contest the probate case on the following ground... (A) That my uncle filed the probate case very late(after 23 years of death) and it is time bared. (B)That the will is forged and the signatures of my grandfather are not Genurine. Sir, my father's brother is taking part of farm land 50x80 sq mm forcefully at his desired location and builded a space for his open machinery warehouse, when we try to evacuate it they are defending and his son threating by saying we will pull gun trigger. My grandfather has mutually divided the farm land between his 4 son 10 yrs ago but now this uncle is creating trouble when this year i lost my job and came to village for farming my land.

Yes sir,mata g jinda h or wo ek loti h na hi koi bhai na behan or unki ma b nhi h.vasiyat me nana g ne likha h ki me apni property apne chacha k bete ko de rha hu esme beti ka koi dakhal andaz na ho or beti k husband jo abhi tak jinda h unke nam ka jikr karte huye swargiy mention kiya gya he.toh kya hum es behaf se vasiyat challenge nhi kar sakte.sir vasiyat 2006 me ki gayi thi jab nana g bimar b chal rhe the....toh aisi condition me ma ko kya karna chaiye koi strong point btay .nana g 2017 me expire ho chuke h.vasiyat rajisterd b h sir.

I have a flat in Bangalore but due to friction with wife since the flat sale agreement was on both names so the sane us not registered. Can u advice the powers of the promoter if he can change it to my name. Is there a confiscation policy if not registered in time. Kindly advice in detail.

Respected sir{kishan dutt g}agar beti k pass koi cancellation deed na ho vasiyat ko challenge karne k liy toh kya sari property relatives ko mil jaygi.....pita ne vasiyat 2006 me bnai thi .jabki unhi death 2017 me huyi ..beti ko vasiyat ki koi information nhi mili 2017 tak.....toh ab beti kese kya documents kis base par vasiyat challenge kare.unke pass yahi ek proof h k wo unki ek loti beti he....kya koi or rasta nhi...2005 k bad kanoon ne beti ko pita k property par barabar adhikar diya h....toh kya 2006 me banai gyi vasiyat galat nhi mani jaygi...us tim par mera hona ya na hona meter nhi karta tha.me 2005 k bad bane vasiyat k rules ko janna chahti hu..please help

I have some doubt that my uncle sign some documents from my father which he can be used to transfer the property to his name - In this case what is the solution? - If my uncle don't have anything then how can I safe myself for future (eg: Will, Power of attorney etc)?

Agr pita ne apni self made property kisi relative ke nam vasiyat kar di.....toh unki ek loti beti us vasiyat ko kese challenge kare.. agr beti ka koi bhai ya ma b jinda na ho. .. .khaskar beti jab shadi shuda ho.????or pita ki property par hi rehti ho...bachi property kese prapt kare,,vasiyat me beti ka koi jikar nhi kiya gya......

A. dear client kindly File a suit for cancellation of such document if your father is dead or ask your father execute cancellation deed.

Can I buy a residential flat in the name of my married daughter by making payment directly to the seller ? This purchase is out of my retirement money and other incomes that been declared in my IT return. I have already paid 50% of sale consideration to the seller and the balance to be paid at the time of registration. Will there be an issue from Income Tax angle or any other law for this transaction. Please suggest if there is any better alternative to avoid query / harassment by authorities by branding this as a benami transaction. . Second part of the question is if I purchase the property in my name now but used by my daughter, will I have to pay tax under the head Income from House property, even if I dont' receive any rent from my daughter ? I have already a self occupied house in my name and I can't show this new property as self-occupied. If yes, any suggestion to avoid paying tax on unearned income ?

Hi, I would like to know if I am exchanging a plot in a layout from landlord with same dimension in Bangalore(survey number & other details are same only change is plot number & schedule & not paying any additional amount to landlord), whether I need to go for exchange deed & pay full registration/stamp duty or I can go ahead with rectification deed by paying nominal fee?
