I purchased a site in 2014. On sale deed, it measures 5.12 acres. I did not get the land surveyed until recently. After survey, I came to know, physically there is only 4 acres in actual. Seller cheated me on this front. Can I file cheating case against him? Also, he is also threatening through his men that there is tenant act on that land and he has a paper to that effect. Whereas in the pahani, there is no mention of tenant at all. In the sale deed too, there is clause which talks about no tenant etc. What shall I do?

A. Approach the cops initially.

I bought a flat in bptp parklands in resale. I received the Possession letter 6 months ago and haven't received OC yet. And there's no registration done yet . I still have dues of some 3lac. Due to some financial emergency I need to sell that flat . Dealers say without registration you can't sell that flat. Is there any way we can bypass registration. And do the registration directly in the name of buyer. So that I don't have to spend another 3 lac for registration .

A. Dear client kindly deal with your dealer for the property Registration. There is no need to make saledeed from your side . Dealer or builder is responsible for delivering property.

Hello, In 2008 we have filled petition in Taluq Court demanding for equal part of ancestral property. We are 4 children 3 sisters and one brother, my father expired in May 2004, and having property of around 88 acrs (+4 acrs undivided in father and uncles). At the time of filing petition we advocate told us we ll get equal part but now he is telling only 11 acrs each all will get. Due to some amendment in partition act in 2004 Sept. Is it true? And is their any provision for our brother who encroached all property after death of my father to go to higher court challenging decision of tq Court?

A. Dear client on that property each legal heirs are eligible for their shares.that encroachment can be removed by court order.kindly go through any experienced local lawyer.

Hello Sir/ Madam, My Mother (58yrs) has three brothers and all are in good terms. But my grandfather sold 7 acres of agricultural land after the demise of my GrandMother in their native Town that was supposedly kept for my Mother . The sale has happened 14 years back with all the 3 signatures of my Uncles (my mother's brothers), but not my Mothers. There is no signature of my Mother or Father. Now my GrandFather is feeling very bad as he couldn't give my Mother her rightful property, whereas all my Uncles got their share of property. My grandfather is thinking of filing a petition but again we are afraid where he and my uncles will fall into trouble as my GrandFather is 87 years old. Please help us here to know if there is any chance for my Mother to claim this property, if so how to move forward without creating a trouble for my GrandFather and Uncles. Thank you very much in advance.

A. Dear client if current owner did all transactions fair legally with legal consideration then you cannot oppose. Even your objection limitations is over.
