Is Inheritance code is applicable for encroached agri land?
My Grandfather had agriculture land which is not revenue(encroached in 1978 ). After Grandfather it is now in the name of Grand Mother. Now my question is all sons has right over the land or not as p

A. Hi,
Agricultural land falls under the state list. But the Hindu Succession Act that applies to majority of Indians – since inheritance of property is generally governed by personal laws – touches upon both agricultural and non-agricultural property.

A. Hi,
In your case, the self acquired property of your biological father may be disposed of only as per his wish. Also u/S 12 of the Hindu Adoption & Maintenance Act, as an adopted child you have persisting right to claim interest in the property of your biological father however along with that would come the need to maintain your biological father's family as well.

A. Hello,
She can give her share by will or transfer the property. Gift deed is might be not possible as still both daughters are not legally adopted by the your Aunt and does not fall under the category of Blood relatives.
