icon Can I sell a property on which case is going on?

My husband gifted his self earned property to me some years ago for security purpose as he married another woman. After sometime he quarrelled with me n left me and then he filed a case in trial court

A. Dear client,
About your husband not paying the maintenance, please contact the divorce lawyer who represented you and tell them about this situation. A criminal liability raises upon on your husband as soon as he failed to pay the alimony ordered by court.

And, yes you can sell the property unless there is no stay order passed by the Court upon that property. But the buyer should be aware of this situation. If you try to hide it, then it might land you in more trouble.

In this scenario only the wife is the legal heir of the deceased parents and not you. If the wife being the legal heir has denounced the property then you being her husband will not be legally allowed to contest and get a share out of it.

In case you are able to prove that your brother cheated with you and got the property (land) registered in his name along with one sister then you can get back your share. For this you will have to file a title suit and provide sufficient proof to the court about the fraud committed by him.

A. Dear Client
What was the legal document created to transfer your grandfather's property to his name by your uncle? What you need to do is to prove in the court of law that your uncle fraudulently has transferred all the ancestral property in his name. Try to file a partition suit in a civil court and then establish the fact that what he did was wrong.

We have an apartment with 130 flats. While the MC has taken over the management of the apartment 10 years back, the builder hasn't given clear calculation of the UDS tallying to the total area and als

A. Dear Client
What your builder has done and is doing appears to be malafide and is going to impact the legal rights of all other residents of the complex. The MC should set up a meeting with the builder to sort the issues and if required legal recourse can be taken depending on the outcome. Also on the issue of selling the portion of the clubhouse to a third party MC can go for obtaining a restraining order from the court.
