A. WILL registration is not mandatory.
You can get flat on basis of WILL of mother.
you can go for declaration suit as last straw.
WILL is very important and everyone should make it (registration is not required).
so you also make WILL for your son. you cant do gift deed until it transfer to your name.

A. First you need to immediately contact a lawyer to prepare your suit for recovery of possession if you can satisfy the court that you are entitled to it. You case hangs on very fine balance and unless few facts stands in your favour it would be very difficult for you to recover possession in such cases.
