Can two members of the same family be members in a Co-operative Housing Society in Maharashtra, after the society has been registered?


A. Section 5. Restrictions on registration:- No society, other than a society of which a member is a cooperative society, shall be registered under this Regulation unless it consists of at least ten persons ( each of such persons being a member of different family) , above the age of eighteen years and residing in the area of operation of the society.

Yes, you can extend the window grill and get it fixed. Law does not restrict it. But it shouldn't restrict the way for the passengers on the road. Thank You

I am owner of flat in the society and purchased one unit of Stilt Parking from Builder, against which I only received Allotment Letter from Builder and not having separate registered agreement for it.


A. Hi,
Since the allotment letter has been issued in your favour by the builder, your rights cannot be denied. An allotment letter is admissible in court and society cannot take away your rights if you have already paid the charges for the said parking and an allotment letter has been issued in your favor.

If you have ben in uninterrupted possession and use of the property since 1991 (more than 12 years), you can file a suit for adverse possession.

If you grandmother was not the sole legal owner of the property, then the PoA given by her would be invalid. File a complaint against X for cheating and fraud under Sections 415 and 420 IPC.
File a suit for declaration of title accompanied by an application for condonation of delay.
You can also approach the Court to grant an injunction or stay order to prevent X from further alienating your rights over the property.

Yes, it will remain valid even if your father in law and mother in law die. The POA was executed by your wife, so it will remain valid until she is alive. Father in law and mother in law's death wouldn't affect the attorney made in your favor.

A. Just get the fair value MARKET selling PRICE with the HIGHEST & LOWEST Current market rate of the property . make middle price of HIGHEST & LOWEST Current market rate.
