A. Legally speaking, you have no option but to pay the remaining dues of the corporation so that your parking lot gets released in your name i.e. you need to get your name mutated on the basis of the registered sale agreement/letter of allotment in your name in the property tax records both for the flat and the parking lot. Thereafter, you will have to fight a battle with the society office bearers also, try convincing them once you have paid to the corporation and obtained receipt and clearance in ...ReadMore

A. Hi Santhoshini,

I strongly suggest sharing the sale agreement to find out the clauses/ suitable clauses before we make a solid opinion.

However, legally speaking we are binding on the clauses of the agreement and dispute on the payment of booking/advance amount needs to analyze as per the practicality.

A. Hi Sandhu,

We need to examine the position of the property, Muslim law and it's applicability.

I strongly suggest getting us all the documents and let's regularised it in your father or whomsoever name your grandfather deem fit during his lifetime to avoid any issues in the future.

A. Hi,
You have a equal share in your fathers property along with your brother. You have not mentioned whether your mother is alive or not. If she is alive, then the share in the property will be of three equal portion. However, if your brother has built a house in the land owned by your father, you have a good case for filing a partition suit against your brother. Please consult a local lawyer and arrange to issue a legal notice to your brother first.

A. Hi Vinay,

The explanation is not brief enough for the right opinion, however, you have purchased the property by paying the consideration and registered the same, you are now the title owner, I don't see any hurdle for any dispute. Hope you have done the title search.

NCLT proceeding must have initiated against the builder and it's property, if they included your property in their claim, let's have the objection at NCLT with solid proof that you have paid for the same and under rightful posse ...ReadMore
