Another option is you also put another LOCK to this cycl e& teh owner in few days will come & ask u to remove your LOCK.... Builder has no right to say to you that you cannot get penalty because u are a second buyer. Before getting possession only you can file case against the builder in civil court or in consumer forum for delaying the possession.
The limitation period is 2 years to file consumer case. To get penalty you can go through the agreement which was signed by you and the builder.

A. 1) Sorry to say that you have NOT mentioned from which city you want to form the society as the process slightly changes as per the jurisdiction, 1st get all the papers that the builder is willing to give. Also request you to appoint a Property Lawyer for the same.
