A. Dear Sir/ Mam, Since both of you are above 20, the girl is a major and the boy is a minor. The girl may conduct her life the way she wants because she is an adult but the boy is still a minor. Having physical relationship without the consent of each other is a crime and with minors is an offence. In your case the girl hapoens to be a major and the boy is a minor at the age of 20.

Although there was mutual consent for sex but the purpose of the boy was to just use the girl on fake promise of marriage and the girl believed that he is going to be her husband and then the boy just evades after having fun

A. Dear Mam, When you attend the age of majority, it is assumed that you would take decisions with sound mind. At the first instance, you should not have entered in to physical relationship as because after marriage that wouod have anyways been there, so this stop should have come. Secondly, if you were having the hint that the intentions of that guy was that and when he approached, you shoud have consulted your parents and made them aware instead of giving him consent. Loyalty is very rare and please do not expect it from everyone.

Hi, A Family friend (widow) and my wife both working together in same school. That widow lady filed a fake rape complaint on instigation of my wife (living separately),against me with police in 2016. When police called lady and me in police station. That lady withdraw the complaint by saying that her daughter is grown up and she don't want to proceed further, but in case she got disturbed in future by me she will take action. Then i came to know that my wife and her cousin CA had hacked my Income Tax Online id and password. After warning my wife and when she get adamant in CAW i filed the complaint case and in Oct. 2016 on hon'ble court orders a FIR registered against CA. In November 2016, that lady approach to hon'ble court u/s 156(3) but did not appear in court and after several dates of hearing her council argued and then FIR registered against me in August 2017. Now please reply with my below queries. 1. That lady in her complaint said that the fake rape is done on 19-2-15 and i am having the recorded calls of the same lady for 20-2-15 and 21-2-15 in which that lady is discussing my issues with my wife and suggesting me also. Is these are valid evidence? 2. That should i hand over another some recorded calls to police right now at this stage in which the same lady is chatting with me and also discussing our family issues and providing solutions to me or shall i wait with these recorded calls to produce in hon'ble court at the time of trial or evidence? Police had not even taken the CDR of the said case even after she filed a complaint case with the hon'ble court as that lady given 24 missed calls and 43 calls to me in that period between the fake incident happened and the complaint filed by that lady with the police (according to Truecaller details with me).

A. Dear Mam, As per the latest Supreme court judgment, Sex under the pretext of marriage is not a crime as because both of them had it consciously. In, order to allege him you need to file a complaint for sexual assault, molestation and violence.

A. Dear Sir/Mam, Sex with mutual consent is not an offence under Law. he married woman cannot punish that man but his wife can punish him.

I have relationship with a boy since last 6 years . We both made physical relationship with mutual understanding. He made a promise to marry me. But now problem is he refuses to marry me because his family do not accept me because i am from another caste.I want to marry him in any cost.My life will be spoiled without him.. A. If you want to marry him then you need to convince him and since you both are of legal age you have the right to marry. If,you forcefully marry him then after marriage your life and situations would not be the same as you might expect it. Coming on to Law points, Sex under the pretext of marriage is not an offence to be constituted under "Rape" as because it has been done with consent. If there was force, then it has to be proved. So, you need to be wise enough in choosing your way.

without medical examination, can rape be proved? if a girl said no to medical? is consensual sex a rape?

A. Medical examination is the basis for proving the happening of rape but if such circumstances existed which have prevented the medical examination at that point of time, but there are sufficient other evidences available which prove without doubt the happening of rape or sexual assault, then the courts may accept the contention. This depends on how strong the case is and the degree of proof that has been established. In relation to your second query, consensual sex would amount to rape only if the girl is not an adult according to our Constitution.

A. The perfect answer to your query would be given if you had mentioned the state of happening of the incident. The in general time is 30 days in cases of rape incidents which may be filed even before by the police authorities. The later varies from state to state.
