A lady in our office conducted a meeting girls instructing girls to attend beauty parlour do their waxing as she got complaints from some men saying that they are not comfortable with girls having the hair on their hands. When I complained this to my manager he asked for apologies and from then onwards they started humiliating me and adding obstacles to my work and spreading rumours about me saying that I am not working properly and I am not regular to office. One day client came along with my manager and shouted at me on the floor in front of all the employees without my fault. We don't have ICC in place in our organization. When I complain to hr, they are saying that client is a big man who brings revenue to the company and they cannot take any action. I want them to be punished. What can I do now? Can I sue my manager and client and organisation?

A. Yes, you can file a complaint to the higher officials of the company stating the whole incident and for causing mental harassment due to the act and also mention that due to non-complaince of mandatory provision of forming the ICC you are facing humiliation and deprived of your legal right,
you can serve them a legal notice claiming compensation on account of mental trauma faced by you and for not forming the ICC,

One of my team member filed a case against me with ICC committee. The committee has not given me any notice or copy of complaint or disclosed the name of the complainer. They called me for discussion and asked general questions only once. After three months they sent me an email stating that they their inquiry is completed and the report has been submitted to the management. After 20 days, my employment was terminated therefore I asked for copy of the ICC committee decision/report. After several follow-ups, the committee gave me copy of the complaint which seems fabricated post my termination. They have investigated the case with the people left the organisation but no inquiry done with my existing female team members. They have not given me any chance of proper hearing. I believe the committee is working under the influence of my HR manager who used to dislike me. I am jobless since three months and not able to get any job and unable to hire costly lawyer. Please help me how should I proceed with an appeal and where?

A. not providing you an opportunity during the inquiry is against the principle of natural justice and equity, bad in law, null & Void,
you are advised to challenge the same by way of filing a writ petition in the concerned High Court

After the office hours me and my lady colleague went out for dinner and we had few drinks too. While coming back to hotel we had some romantic discussions in the car. Then we continued to have few drinks at my room in the hotel adn in inebriated condition I kind of touched her adn nothing more than that happened. Hi sir, I want some advice as I have filed FIR against my supervisor who harasshed me physically at my work place. Not only with me but also happend with other females as well. I complained with HR but because of their position Higher mgmt was supported him several month. They were only conducting meetings and passing time when I realized they will not take action I complained to the police. after complaining police company has taken action and the physical harassment committee has proved him guilty on the basis of evidence on record. But due to all these I suffered alot approx 1 and half year. Still they are harassing me mentally. They have given me lowest rating and I was not recommended for the year end revision etc. Everytime I have to mail for my rating revision n all. And still I'm sitting idol at home they are not calling me to join back. My Image is also destroyed in the company. I want to know in this case can I sue the company or that culprit for defamation.

I have filed a complaint of sexual harassment at work place against my manager and a complaint against my HRD head for trying to put pressure on me to keep quite about the matter. Later ICC was constituted and I was called to present my case. ICC was biased from the beiging only and gave decision against me stating that my complaint was false and malicious and that I am unwilling to work, incapable and lodged complaint just to avoid work pressure. I am an outstanding officer through out my service of 4 years with excellent track record, I am one among 2% of the officers recently promoted and worked very hard for this organisation. Due to influence of officials on very high post aginst whom I lodged complaint the IC ruled against me. What can I do now? What are my options?

A. By ICC I think you mean the internal Committee that carried out enquiry on your complaint against HRD. Your organisation must follow certain rules of Natural Justice and should have a appeal mechanism. If it does not have still you have a right to either of these: 1. comment on the enquiry report, 2. to appeal against the decision, 3. for a reply to a show cause notice why the case should not be dismissed. Also, if yours is a goverment isntitutiuon, you can approac Court/s.
