Human Rights Laws
Human Rights can be defined as the rights of a human being which are fundamental & legal in nature. Human Rights are the standard & norms of human behaviour in municipal & international laws.
Fundamental rights which has been incorporated in the preamble of each & every country's constitution i.e. the framework of laws which has to be explored while making other laws consists of the rights which each and every resident of that country enjoy are the human rights.
Violation of any rights or oppression from enjoying any fundamental freedom which is incorporated as in the constitution subjects to human rights violation. Mainly inhumane torture, execution, unlawful imprisonment are some examples of human rights violations.
In India, custodial deaths, slavery & sexual exploitation are the problems which subject to human right violation. D.K. Basu v. State of West Bengal, with Ashok K. Joshi v. State of U.P., A.I.R. 1997 S.C. 610, p. 617 are some cases which refer human rights violations in custody i.e. third-degree torture.
It has been stated that no prisoner or a person who is in detention to police custody cannot be subjected to third degree torture for accepting guilt or divulging of information.
Slavery in India is a major concern slavery in India has been a thorn in the society since to medieval period to even now in the modern society, trafficking has been a major concern in India & despite strict laws such as section 370 of INDIAN PENAL CODE still it has remained a common problem.
Sex Trafficking from India to abroad mainly in gulf countries has been a stigma in the Indian society.
The international forum i.e. Universal Declaration of Human Rights(UDHR) the United Nations General Assembly in Paris on 10 December 1948 (General Assembly resolution 217 A) as a common standard of achievements for all peoples and all nations. It sets out, for the first time, fundamental human rights to be universally protected.
Sexual Harassment results in violation of the fundamental rights of a woman to equality under articles 14 and 15 of the Constitution of India and her right to life and to live with dignity under article 21 of the Constitution and right to practice any profession or to carry on any occupation, trade or business which includes a right to a safe environment free from sexual harassment.
