The legal system in India is undergoing a wide transformation. There is a massive backlog of cases that needs immediate redressal. In 2025, more than 40 million cases will still be pending in the Indian courts.

Some cases take more than a decade to solve. The worst part about the delay is that it impacts the public Trust in the Indian judiciary. Online mediation is legally recognised, with consent and confidentiality safeguards that affect how ODR platforms store and transmit communications. Also, finality is stronger when the platform is transparent about AI’s role, especially in AI arbitration-style workflows.

AI has a multifaceted role in ODR. The core function, however, is automating repetitive tasks such as document classification, case introspection to generate leads, and conducting extensive legal research in the law code and case law. The result is quicker administrative delivery, ensuring legal personnel can focus primarily on the substantive legal issues.

Meanwhile, AI also powers natural language processing algorithms to interpret complex and long legal texts, extract relevant portions, and draft a consolidated legal archive. These nuances are effective in ODR, where precision and speed are crucial.

Only 0.02% Indians speak English as their first language, and 6.57% as a second language. That shows court documentation or in-session interpretation in formal English can create an impediment to many defendants and plaintiffs. 

AI models ensure that people can take part in court proceedings in any of the 22 official languages in real time. Therefore, people with variable literacy levels can easily overcome linguistic barriers to the propagation of justice in India.

Accessibility Beyond Language

Accessibility is bigger than translation. Language support helps, but it is only one gate. Many users struggle with the process itself. Where to click, what to upload, what a “claim” even means, and what happens if they miss a step. UNCITRAL’s view of ODR is procedural, not cosmetic. 

That implies that online dispute resolution platforms should explain process stages in plain terms, show users what they are agreeing to, and give them a chance to correct misunderstandings. This is where “efficiency” becomes tricky. A platform that resolves disputes quickly but leaves weaker users behind is not improving justice. Rather, it is redistributing inconvenience. That is why accessibility should be treated as a fairness infrastructure, not as a nice-to-have feature.

Case Examples of Peripheral AI Involvements with Justice in India

AI’s involvement in India's real-life justice landscape is no longer theoretical. Back in 2023, the Punjab and Haryana High Court came into the limelight for the same. Justice Anoop Chitkara used the AI tool ChatGPT to interpret bail jurisprudence in a series of assault cases. 

In that case, the AI's input was specific to particular cases. However, ChatGPT underscored a sequence of legal principles that demonstrate how AI supports in-depth legal reasoning.

The next case takes us back to the Delhi High Court. The court sought the help of ChatGPT in a trademark tussle based around Christian Louboutin. Judges used AI to interpret the brand’s reputation on a global scale.

The court, however, judged that AIs involved in that case were purely supplementary and not determinative in any way. However, the step marked the beginning of a landmark journey towards AI-centered adjudication.

The integration of AI into the Indian legal nomenclature has impacted national adjudication. The Indian Supreme Court has launched a tool called SUPACE (Supreme Court Portal for Assistance in Court Efficiency), followed by SUVAAS (Supreme Court Vidhik Anuvaad Software). 

The former leverages AI to assist Supreme Court judges with legal research. While the other (SUVAAS) interprets the judgment in local languages using the elementary NLP tool. The two tools have enhanced judicial productivity, especially in contexts where a multilingual approach can evade or cloud court proceedings. 

Platform-Level Mini Scenarios

The court examples are useful, but AI in online dispute resolution looks different when it sits inside a platform workflow. Think of a consumer dispute where a buyer claims non-delivery. 

An ODR platform can use AI to classify the dispute, ask targeted questions, and pull relevant records. Then it can propose a settlement ladder, such as a refund, replacement, or partial credit. 

The moment AI starts labelling one party as “likely wrong,” the platform moves from process support to moral authority, and that is where legitimacy risk begins.

Another common workflow is small-business invoice disputes, where documentation is messy, and parties argue over scope. AI ODR India tools can summarise documents, flag inconsistencies in timelines, and help parties identify what evidence is missing. 

In AI mediation mode, the system can suggest negotiation prompts and package issues into smaller blocks, making settlement possible. But it should never pressure a settlement through misleading certainty. 

Platforms should allow the neutral to control the flow, because facilitation requires judgment and context. That is what machines still struggle with.

In fact, ODR platforms often succeed when AI structures the dispute rather than “deciding” it. The legitimacy line becomes fragile when the system starts presenting predictions as verdicts.

A concrete policy framework backs the AI journey in Indian adjudications. In March 2024, the Indian government launched the IndiaAI mission. The budget for the same was staggering INR 10,300 crore. As a part of this project, the government is planning to build:

This one is a credible computing software solution with 18,000 GPUs built in. They will aid AI research and deployment in critical cases countrywide. 

IndiaAI FutureSkills

This scheme incorporates training programs, fellowships, and certifications to nurture AI talent across multiple Indian sectors, including the legal industry. 

IndiaAI Dataset Platform

It is a centralized repository of various random datasets that fuels countrywide AI development. 

All these efforts are in line with the Digital Personal Data Protection Act, also known as the DPDP Act of 2023. This act provides a rigorous legal framework to enhance data privacy and user consent regarding the use and involvement of AI.

 

This is especially contextual for the ODR platforms that handle a significant share of sensitive legal data. The act ensures fast and secure data processing, followed by transparent proceedings and rigorous accountability, the elementary principles that govern AI deployment. 

In addition, NITI Aayog has suggested a phased implementation strategy to improve ODR operations. The main focus of the changed landscape should be awareness campaigning, regulatory reforms, and capacity building. 

Spoken initiatives can help create a robust, balanced ecosystem where innovation takes the driver’s seat while respecting fairness and transparency.

DPDP Compliance As Workflow

The Digital Personal Data Protection Act, 2023, is not only about privacy in principle. Rather, it changes the workflow. A platform that runs AI ODR in India needs a real consent-and-notice rhythm, because dispute data is inherently sensitive. It also requires clarity on who the data fiduciary is and who is merely a processor, especially when third-party AI tools or translation engines are used. 

DPDP sets baseline expectations for lawful processing, notices, and governance through a Data Protection Board, making platform compliance more than a checkbox.

Here is where it gets practical. DPDP pushes you to think about what data you truly need, for what purpose, and for how long. ODR platforms often keep everything, just in case. That is risky. Under DPDP, retention should be tied to purpose and necessity rather than habit. 

Also, grievance redress is no longer just a customer service feature. It becomes a legal expectation around user rights and complaint handling. That tightens platform accountability. 

If a system uses AI mediation or AI arbitration features, it should clearly disclose the role of automation, because consent without meaningful notice is a weak foundation.

Essentially, DPDP compliance requires notice-and-consent structures, plus clear role splits between the data fiduciary and the processor. Also, retention and deletion logic should be purpose-driven rather than convenience-driven, because dispute data is inherently sensitive.

Why AI Legal Tech in ODR Makes Sense: Benefits and Leverages?

The incorporation of AI into ODR has a range of typical benefits:

  • This reduces litigation count and promotes early settlement

  • AI adapts to the nature of disputes and personalizes the dispute resolution pathway.
  • It significantly improves the rate of dispute resolution. 

The Flip Side of Legal Innovation- Challenges Ahead  

ODR faces multiple challenges despite its promise of better adjudication. Therefore, it is crucial to underline those issues. The first and foremost issue is the digital divide. 

Around 45% of Indians have only proper internet access. With this strength, normalizing the IA-powered ODR is next to impossible. India needs a better digital infrastructure. 

The next big gap is biases and concerns regarding fairness. AI can assimilate biases from training datasets, leading to unfair outcomes. For example, the caste and gender biases of historical judgments are likely to skew AI predictions. To ensure fairness, you need diverse datasets, frequent audits, and adept human oversight. 

However, privacy and data protection are bigger and more imminent issues at the moment. The ODR platforms have to tackle a large amount of sensitive legal and individual data. Meanwhile, AI-based ODRs must comply with all key regulations under the DPDR Act and maintain strict confidentiality. However,  that is the most challenging part too. 

Other issues require prompt redressal before the wholesale adoption of AI in the legal nomenclature. For example, Trust and acceptance remain pressing challenges that AI in law must overcome. 

Numerous Indian lawyers are skeptical of AI-oriented decision-making in courts. To generate Trust, you need to use official AI tools ethically and ensure users understand the role that AI plays in the legal landscape. 

But readers may wonder why some lawyers and justice seekers are skeptical of AI in law. Experts say that India doesn’t have specific rules governing how AI is used in the aid of law. Then, there are accountability questions, too. 

Bias Controls (Data Provenance, Testing, and Feedback Loops)

Bias in AI is not just a moral problem. It is a systems problem. If your training data reflects historical inequalities, the model will quietly treat those patterns as “normal” and then reproduce them with a clean interface and a confident tone. That is why ODR challenges often hide in the recommendation layer, not in the final decision layer. 

AI ODR India platforms should be designed with a bias-control loop, which includes dataset provenance checks, periodic fairness testing, and an option for human-neutral review when the model flags risk. 

Researchers and ODR commentators have warned that AI-driven ODR can hamper access to justice if oversight is weak and user interaction is not carefully designed.

A simple way to think about bias controls is to ask whether the system can “learn” from disputes it resolves, not in a self-congratulatory way, but in a corrective way. Platforms should track user objections, settlement drop-offs, repeated grievances, and patterns of disadvantage. Then they should feed that insight into redesign. 

This is not data stuffing, but governance. If the platform cannot measure fairness signals, it cannot claim fairness. Bias mitigation is ongoing and a lived process, tied to user outcomes and trust.

That means platform features like recordings, transcripts, AI summarisation, and translation are not neutral choices. They shape confidentiality risk. 

If a platform uses third-party AI services for summarisation, it should be clear whether data leaves the system, how it is protected, and whether it is retained. These are not technical details for later. They are legal design decisions.

There is also a practical trade-off that people often avoid discussing. The more “smart” the platform becomes, the more data it touches and the larger the confidentiality surface. 

AI mediation features should minimise what they store and maximise what they process ephemerally. That aligns better with confidentiality norms and reduces the risk of breaches. DPDP also reinforces that platforms should process only what is necessary for lawful purposes, and they should not retain data longer than needed. 

So confidentiality and data protection end up walking hand in hand, even if teams treat them as separate compliance projects.

At the end, confidentiality is a system design requirement, especially for online mediation, not only a professional promise. Meanwhile, data minimisation and retention discipline reduce confidentiality risk and support DPDP compliance.

Where Does It Come Down to?

The main question is: who will bear the onus if AI makes mistakes? The question remains unanswered. India needs clinical guidelines, along with an adept legal framework, to address these upfront concerns. 

The accountability question is not one question. It is a chain of responsibility, and online dispute resolution platforms need to admit that. If an AI tool screens disputes, suggests outcomes, or nudges settlement options, someone should own that design choice. 

UNCITRAL’s ODR guidance treats roles and responsibilities as part of the process architecture rather than as an afterthought. 

That implies governance and not just “we used AI ethically.” Governance means defining who reviews outputs, who can override the model, what triggers escalation to a human neutral, and how parties can challenge a result they believe is flawed.

Audit trails are the boring part that saves institutions in the long run. When a party disputes an outcome, what matters is whether the system can show what data was used, what was recommended, and what the human decision-maker did with it. AI mediation tools should log the support they provide without capturing unnecessary confidential content. 

AI arbitration-style systems should provide explainable reasoning cues, at least in plain language, because opaque decisions feel illegitimate. The platform should also have an escalation layer for edge cases, where the model’s confidence is low, or bias risk is flagged. That is not only ethics. That is procedural self-defense.

In fact, accountability improves when AI outputs are reviewable, logged, and linked to a human decision-maker of record. Also, escalation triggers matter. Not every case should be auto-processed, especially when the dispute is messy or power-imbalanced.

Standards and Best Practices

India does not need to wait for a perfect AI statute to define responsible practice. There are already well-articulated ODR principles globally that focus on transparency, competence, confidentiality, fairness, and accessibility.

If online dispute resolution is going to scale, platforms should publish their process rules, determine what AI does and does not do, and ensure users have meaningful consent and exit options. Without this, ODR becomes “fast resolution,” but not necessarily legitimate resolution.

This is also where AI arbitration has to be handled with discipline. If a platform offers arbitration-like outcomes, users should know the applicable standard, who the neutral is, and how decisions are reached. 

AI can support consistency, but it cannot replace the accountability of a human neutral unless the entire legal framework is designed for that, which is not the default. Standards help by forcing platforms to articulate boundaries. Boundaries are what build trust. In practice, trust is the real currency of AI ODR adoption in India.

Measuring Success

If AI is going to be trusted in online dispute resolution, the system needs a way to prove that it is not only fast but fair enough. Metrics do not have to become an obsession, but some basic signals matter. 

For example, how often users drop out mid-process, how frequently outcomes are reopened, and how often grievances claim misunderstanding or coercion. These are not vanity numbers, but fairness indicators. 

ODR challenges arise when users do not understand what they agreed to or feel nudged without clarity. A platform that measures only speed will miss the real risks.

A second layer is qualitative. Did users feel heard? Did they understand the process? Do they have the option to ask for a human neutral? 

UNCITRAL’s ODR framing treats communication and roles as core, which implies user comprehension is not optional. When AI mediation tools are used, a platform should check whether the AI summarised fairly and whether users felt accurately represented. 

When AI arbitration support is used, the platform should test whether the explanations are intelligible. If users cannot understand the result, they will not respect it. That is the simplest truth here.

In this situation, AI-powered ODR can offer a genuine and scalable solution. From quicker case management to the democratization of legal services, there are immense opportunities for AI adoption. However, India needs to balance out the risks associated with bias, privacy, and accountability.
