The Property concerned is a Constructed Building Which was Constructed by Me. The Land was in the Joint Ownership of My Brothers while I did the Construction on that Building in Capacity of a Constructor/Contractor. One of My Brother Died a Year Ago. His Wife also Died 14 Years Back. He has a Minor Daughter 16 Years of Age. The Succession Certificate of Property is in the Name of his Daughter and Since She is a Minor, I have been appointed as the Guardian of her and She Lives with Us. Now the Half Share is of My Brother who is alive and the Other Half Share is Owner by Minor and I am Guardian of Her. Also, Before My Brother died He Along with the Other Owner, i.e. My Another Brother, did Sale Agreements with Third Parties for Sale of Flats, But Before Sale Execution He passed away. Now, How and On What basis to Take Permission from Court for the Sale of Building since the Building was constructed for Sale Purposes only and I can get My Reimbursment as a Contractor of Building. Will The Court consider the case in favour of Sale Permission ? and How to Approach the Case ?

A.Dear client,
This is a complicated case and we cannot consult you online without looking into the document. You need to file a petition under the Guardians and Wards Act in the court of Guardianship Judge to seek the permission of the court to sell the share of her minor daughter. You cannot do it on your own, better consult a lawyer.
