Manohar and Madhukar are brothers. They have an ancestral joint property in a village. It was a open land. The land is partitioned between both brothers in equal shares. Both shares are registered on their name separately in Grampanchayat records. Manohar was not residing on his land and he allowed his brother Madhukar to build a house on his land to reside as he was residing in city far away from his village and was not willing to reside on his land in village. So, Madhukar build a house on the land of Manohar and he is residing there since 40 years. 7 years before Madhukar has build a new house on this land demolishing old house with permission of his brother Manohar and his son. All this dealing was settled orally. At that time, Manohar and his son promised that they will transfer their land on the name of Madhukar and Madhukar and his son will transfer their land, which is still open, on the name of Manohar. Now, Manohar is dead 1 year before. After his death the heirs of Manohar is going to register their names on the land of Manohar on which the house is built by Madhukar. Madhukar is requesting them to transfer this land to his name and he will transfer his land on the names of Manohar's heirs. But now Manohar's heirs are not agree for that and they are claiming on their land with house built by Madhukar on that land. They have applied in Grampanchayat for registering their names on the land of their father Manohar. Grampanchayat has sticked a notice on the house of Madhukar in his absence. Madhukar and his heirs are ready to transfer their open land on the name of heirs of Manohar. But the heirs of Manohar are not ready to transfer their land on the name of Madhukar. It should be noted that Madhukar is residing in this house since 40 years continuously and he is paying property tax and other taxes since 40 years on the name of Manohar. Now Madhukar is 78 years old and in this age the heirs of Manohar is trying to homeless Madhukar and his wife.

Please advice us what legal steps can be taken to register the name of Madhukar on the land of Manohar if the heirs of Manohar is not ready to interchange the names on grampanchayat records for both properties.
