Hi all,

Please guide whether have to take bail from police station or court.

FIR was filed in Nov 21, got stay from Allahabad High court they transferred to meditation meditation bench which was failed so court cancelled stay order in sep 22.

Police took our statement on 41a and now filed chargesheet under 498-A,323,504,506,3/4,3/4.
police removed sec 377 from FIR.

Not received any notice but online status showing appearance status on 25 nov.

My lawyer told me that will try Stay on chargesheet.

What will be the correct step to get bail from lower court or try to stay on chargesheet from High court?

Can me or my family member get bail from police station?

A.First of all you and your family need to take bail from the court and then once the bail is granted then you and your family shall be free from the harassment of the police authority. Then you need to receive the free copy of the charge sheet from the court and see that the police have submitted what report against you and your family. Then the necessary steps shall be taken as required. You need to consult with a good advocate who deals with this type of cases and have expertise knowledge otherwise you and your family shall suffer severely. You may seek the help from Vidhikarya Legal Services as they provide advocates according to your need and you will get justice without any delay.
