Their is a property under my grandfather's name who died without a will. He had 6 legal heirs among them my father is one of the legal heirs. my father died in 2020. Today we get to know that the other legal heirs have done mutation of the property without our knowledge. The mutation was done on 6 heirs but my father died. Is it legally possible of mutation without the permission of other legal heirs? And after my father's death does the legal heirs documents of my grandfather's needs to be updated ? Is the mutation a fraud? Does the mutation would be on my father's name or one father's legal heirs as my father died .

A.Dear Client,

It appears from your query that you may get the answers to all your queries once you visit the Office of BL& LRO or DL & LRO. your being a coparcener/legal heir of ancestral property of your grandfather, you are entitled to an equal share in the said property once you file a suit for partition in the Civil Court. Once you file the civil suit in the Court in respect of said property, all the cause and facts may come out behind the mutation of land in the absence of one legal heir. A.Dear Sir,
You may go to higher revenue officers challenging such mutations and also lodge a complaint with Police. Secondly you can file a partition suit immediately and get stay in respect of alienation/transfer of such properties otherwise they may sell the properties.

Thank you for your response sir. Actually my name as a heir is being included in the property of mutation in my grandfather house this year. But I am now in Canada the mutation is done without my knowledge. And when I was in India on my grandfather's legal heirs document me and my sisters were not included. How can a mutation be possible like that ?

A.Hi client,

After a person dies, his legal heirs becomes the next person to receive the any thing in his name legally,unless any special circumstance arises.
If your grandfather do not have a will or a special declaration to not involve in your dad in anything by the virtue of law, then the thing done by your relatives are illegal. Kindly report the same,in the respective office of the BLRO or Municipal Corporation from where this is done. Challenge the same, file a suit. Contact an advocate who expertise in civil matter.
