We gave a month notice in March since we were moving to the UK. But due to the covid Pandemic our plan got cancelled & we told the broker on 25th of March, that we won't move out anymore. He asked is it permanent. we said yes. He understood & said alright. On 7th of April when we called up the landlord to kindly collect the rent from us, he said we are supposed to move out the day the lockdown is over. This is not fair. Even the agreement is valid till August 2020. Kindly help.

A.Hi Anshu,

Hope you are doing good.

We understand the situation is different than the normal, as you know he might have committed to someone as you supposed to go UK, I guess you should talk to him, make him understand the difficulties and reason behind for changing the plan and come to a settlement wherein you may stay or get enough time for finding a new place. In the same time the subsequent tenant also should benefit from the discussion if any.

Legally speaking, after serving the notice, you have lost your tenancy as the same is voluntary and the natural cause can not use as tools for any solving any dispute, hence after the situation gets normal, the landlord may have good ground for fighting it out with the contention that he has allowed staying during the lockdown ever after terminating the agreement may have the validity till Aug/2020.

A.Since the agrement validity is still valid in that case landlord can ask you to leave the house.

And in the current situation if landlord
Ask the tenant to vacant the house.

Then landlord would be penalized with rigrous punishment of 2 years.

If broker is forcing to vacant the house after lockdown and before expiry of validity in that case just informed the nearest police station or approach the court and registered your complain under section 153(3).

So dont worry...as it is complete lockdown.
Stay in home is just the solution

A.Thanks for your enquiry. You can send another notice with the explanation of covid 19 lock down. Even as per govt guidelines landlord should not insist to pay rent. If we start issues you can lodge police complaint against him. Don't worry.

A.Dear Sir,
Rent laws are not in favor of landlord, in fact the land lord has to approach the court after issuing notice to you so it takes few months or years to get an order for your vacation. Stay calmly. Nothing to worry.

A.No landlord urges the client to vacate though it was agreed already. If your landlord is not ready to collect the rent from you, thn deposit it in his bank a/c. through Google pay etc., or if you can't deposit in the above manner thn text him your readiness to pay the rent and ask him to send his details.
